The person who wrongly accused Mr. Nen was asked to pay back 10 billion VND.
Providing more than 10 billion VND in compensation for Mr. Nen's wrongful conviction, the Ministry of Finance requested the Supreme People's Court to determine that those who caused the wrongful conviction must be responsible for repaying this amount.
The Ministry of Finance has just issued a documentaccepted the Supreme People's Court's proposal to provide more than 10 billion VND in compensation for wrongful conviction of Mr. Huynh Van Nen. This amount is taken from the central budget's administrative management expenditure source approved by the National Assembly.
However, the Ministry of Financealso requested the Supreme People's Court to direct the People's Court of Binh Thuan province (where Mr. Nen was tried) to "determine the responsibility to repay the amount of money" for the public servant who caused the wrongful conviction.
This is done according to the Joint Circular of the Ministry of Justice - Supreme People's Court - Supreme People's Procuracy. Accordingly, the Supreme People's Court is responsible for urging the reimbursement and sending the results to the Ministry of Finance.

Earlier this year, after seven negotiations, the People's Court of Binh Thuan province agreed to compensate Mr. Nen more than 10 billion VND for two wrongful convictions he had to endure for 17 years.
Regarding the handling of the person who wrongly convicted Mr. Nen, the President dismissed Mr. Nguyen Thanh Tam, the intermediate judge who presided over Mr. Nen's trial in 2000. Mr. Tam was also dismissed from his position as Deputy Chief Justice of the Criminal Court by the People's Court of Binh Thuan.
Judge Tran Thi Thien Huong - Deputy Chief of the Administrative Court - People's Court of Binh Thuan province said that the unit has not received the money yet so has not yet compensated Mr. Nen, and has not yet considered the responsibility for compensation.
"The request for compensation from those who caused wrongful convictions will be carried out according to the provisions of the Law on State Compensation," said Ms. Huong.
In April 1998, Mr. Nen was accused of using a rope to kill Ms. Le Thi Bong and steal her gold ring. More than 2 years later, the Binh Thuan People's Court of first instance sentenced him to life in prison for murder, 3 years for robbery, and 2 years for intentional destruction of property; the total sentence was life in prison. During the investigation of this case, Mr. Nen and 9 of his wife's relatives were accused of killing Ms. Duong Thi My in the "cashew garden mystery" that occurred 5 years ago. Due to the lack of evidence of their criminal behavior, 12 years later, the investigation agency had to exonerate them and pay nearly 1 billion VND in compensation. Mr. Nen, who is serving a life sentence, was not prosecuted. As the only person in the history of Vietnamese litigation to be wrongly convicted of two murders,At the end of 2015, Mr. Nen received a public apology from the People's Court of Binh Thuan in the locality because the police found the murderer of Ms. Bong. In April 2016, Mr. Nen filed a petition asking the Binh Thuan People's Court to compensate him 18 billion VND due to being wrongfully convicted in two verdicts. |
