Many people wonder whether the last year before retirement (male workers 59 years old and female workers 54 years old) can work reduced hours or part-time. Is there a mandatory regulation in this field on shortened hours and a regulation requiring employers to pay for this shortened time?

According to Clause 10, Article 3 of Decree 45/2013/ND-CP, it is stipulated that: Elderly workers are shortened by 1 hour and paid for this shortened time in the last year before retirement.
Clause 3, Article 166 of the 2012 Labor Code stipulates:“In the last year before retirement, employees are allowed to shorten their normal working hours or apply a part-time working regime,”There is no mandatory provision for paying reduced working hours to employees in the final year before retirement age.
According to Clause 1, Article 4 of the 2012 Labor Code, agreements that guarantee employees more favorable conditions than those prescribed by labor law are encouraged.
