Former Deputy Director of Department of Agriculture and Rural Development was prosecuted for 2 crimes
Former Deputy Director of the Hanoi Department of Agriculture and Rural Development, Mr. Phan Minh Nguyet, was proposed to be prosecuted on two charges: Abusing position and power while performing official duties and embezzlement of property.
The Ministry of Public Security's Investigation Police Agency has just completed its investigation conclusion, proposing to prosecute Mr. Phan Minh Nguyet (54 years old, former Chairman of the Board of Members - General Director of Hadico Company, former Deputy Director of the Hanoi Department of Agriculture and Rural Development) and 5 defendants for the crimes.

Mr. Nguyet was proposed to be prosecuted for two crimes: abusing his position and power while performing official duties, embezzling property, and intentionally violating State regulations on economic management, causing serious consequences.
According to the investigation agency, before holding the position of Deputy Director of the Hanoi Department of Agriculture and Rural Development from 2011-2013 when he was Chairman of the Board of Members - General Director of Hadico, it was due to personal gain and other personal motives.
Defendant Phan Minh Nguyet took advantage of his position and power to violate public duties by collecting and using 3 sources of money outside the accounting books, causing a total loss of more than 22.4 billion VND to Hadico Company and individuals.
Not only that, Mr. Nguyet also directed his subordinate Nguyen Thi Huyen Hao (former chief accountant of Hadico) to collect money from 3 sources for the above amount but did not record it in the company's accounting books. Mr. Nguyet used more than 16 billion VND for personal use and 4 billion VND for the company, but there were no payment documents.
In addition, the former Deputy Director of the Department was also accused of forcing his subordinates to withdraw nearly 19 billion VND of the company's funds for personal use. Mr. Nguyet's purpose was to cover the costs of "running" the project. The "running" of the project was Mr. Nguyet's personal initiative and was not discussed and agreed upon by the company's leadership.
Accordingly, the Ministry of Public Security's Investigation Police Agency determined that before being prosecuted, defendant Nguyet had returned nearly 15 billion VND to the company, so the authorities proposed to prosecute her for causing damage of about 3.8 billion VND.
By the time he was arrested, Mr. Nguyet's family had recovered 1.8 billion VND, leaving more than 2 billion VND in damages. Regarding the act of embezzlement, the police determined that, as the account holder of Hadico Company, whenever he needed money for personal use, Mr. Nguyet directed his subordinates to withdraw capital from 5 member enterprises of Hadico Company (capital for production and price stabilization) and transfer it to the defendant, totaling more than 40 billion VND.
But when this act was discovered, Mr. Nguyet had borrowed 19 billion VND from MHB Bank - Hanoi Branch and from several other individuals to compensate for nearly 26 billion VND. Based on the above evidence, the police agency believes that Mr. Nguyet must bear criminal responsibility for the act of appropriating more than 14.8 billion VND. To partially remedy the consequences, along with the request for prosecution, the police agency proposed to reduce Mr. Nguyet's criminal responsibility.
Ms. Nguyen Thi Huyen Hao, former chief accountant of Hadico Company, was also proposed to be prosecuted for the same two crimes as Mr. Nguyet, with the role of aiding. Meanwhile, the defendants Do Van Hao, former Deputy General Director of Hadico Company, Dang Thi Thanh Tam (Director of the Hanoi Agricultural Investment and Development Company Limited Branch - Tu Liem Tourist Orchard Enterprise), Duong Thi Chinh (Chief Accountant of the Hanoi Agricultural Investment and Development Company Limited Branch - Tu Liem Tourist Orchard Enterprise) were prosecuted for criminal responsibility for the crime of Abusing position and power while performing official duties.
Nguyen Trong Hung - former Director of the Hanoi Agricultural Investment and Development Company Limited Branch - Bac Ha Enterprise was prosecuted for criminal liability for intentionally violating State regulations on economic management causing serious consequences.
Defendant Hung was identified as the mastermind when he signed forged documents to rationalize the withdrawal of money borrowed by Bac Ha Enterprise from Hadico for production and price stabilization purposes and transferred it to Mr. Nguyet for purposes other than the loan, causing a loss of more than 20 billion VND to Hadico.
