Former head of notary office proposed for prosecution

All three defendants, former notary office chief, treasurer and construction department officer, were proposed to be prosecuted for fraud and property appropriation.

On December 28, the Investigation Police Agency of Bac Lieu Province completed the investigation conclusion and transferred it to the People's Procuracy of the same level to propose prosecuting 3 defendants including: Tao Van Phung (61 years old, former Head of Tao Van Phung Private Notary Office, Ward 7, Bac Lieu City, Bac Lieu), Huynh Thanh Muot (44 years old, former treasurer of the above notary office) and Tran Thi Ngoc Xuan (43 years old, former officer of the Department of Construction of Bac Lieu Province) for the crime of fraud and appropriation of property.

According to the investigation, in early 2013, Muot became acquainted with Xuan and Huynh Thai Thuy (owner of coffee shop 52, Ward 3, Bac Lieu City). During this time, Muot owed money to the bank and many other people but was unable to repay the debt.

Around June 2013, Thuy asked Muot to borrow money for her by mortgaging the land use right certificate and property attached to the land at 182 Hoa Binh Street (Ward 3, Bac Lieu City), under the name of Ms. Doan Kim Hue (Thuy's mother). Thuy told Muot that Ms. Hue was living abroad, and Muot agreed.

Around November 2013, Muot met Xuan to ask for a loan of 300 million VND, by mortgaging the land use right certificate and assets attached to the land in Ms. Hue's name, and Xuan agreed. Then Xuan met Ms. Tran Thi My Tien (living in Ward 3, Bac Lieu City) and said Ms. Hue wanted to borrow 300 million VND, and Ms. Tien agreed to lend her money, with an interest rate of 5%/month. After that, Xuan met Muot to inform Ms. Tien that she had agreed to lend her money.

Because Mrs. Hue was not at home, Muot discussed with Xuan about forging Mrs. Hue's signature in the contract to appropriate 300 million VND from Mrs. Tien. Muot prepared the contract, forged Mrs. Hue's signature, and asked Phung to notarize it.

In addition, the Investigation Police Agency also determined that from 2012 to June 2015, Muot took advantage of the trust of the victims by repeatedly providing false information to make them trust him and hand over money 4 times to appropriate 720 million VND./.
