According to the Decree, the group of children in special circumstances includes: Children who are orphans of both parents; abandoned children; children without support; children with disabilities; children infected with HIV/AIDS; children who violate the law; children addicted to drugs; children who have to drop out of school to earn a living and have not completed universal lower secondary education; children who have suffered serious physical and mental harm due to violence; children who are exploited; children who are sexually abused; children who are trafficked; children with serious illnesses or illnesses requiring long-term treatment belonging to poor or near-poor households; migrant children, refugee children whose parents have not been identified or who have no caregivers.
Children in special circumstances are covered by or supported by the State to pay health insurance according to the provisions of the law on health insurance.
The State shall pay or support the payment of medical examination, treatment or health assessment costs for children in special circumstances according to the provisions of law on medical examination and treatment.
Children in special circumstances are entitled to other health care policies as prescribed by law.
The State also has a social assistance policy for children in special circumstances. Specifically, the State implements a monthly allowance for individuals and families providing alternative care; supports funeral expenses and other allowances and assistance for children in special circumstances in accordance with the law on social assistance policies.
The State supports food, accommodation and travel expenses according to the provisions of the law on social assistance policies for abused children and children in special circumstances who are under emergency protection according to regulations.
Children in special circumstances are exempted from or have reduced tuition fees and are supported with study costs according to the provisions of the law on education, training and vocational education.
In addition, children in special circumstances are provided with legal aid in accordance with the provisions of the law on legal aid.
Children in special circumstances are supported with counseling, psychological therapy and other child protection services as prescribed in Articles 48, 49 and 50 of the Law on Children.
