Identifying the argument demanding the abolition of the regulation on public ownership of land

(Baonghean.vn) - The Vietnamese National Assembly is discussing the revised Land Law, but hostile and reactionary forces have increased distortions to sabotage our country. Among them, they have put forth many false arguments, demanding the abolition of the regulation on public ownership of land.

Arguments against the people's interests

Hostile forces use many tricks to carry out the strategy of peaceful evolution and sabotage against Vietnam. They take advantage of everything from the smallest things in people's daily lives to the major issues that the National Assembly is discussing.

Recently, taking advantage of some limitations in the process of organizing and implementing land management and use, hostile forces have tried to spread false arguments, demanding the abolition of the regulation that land belongs to the entire people, which goes against the interests of the people. Reactionary elements have taken advantage of some "hot spots" inland management and useDue to historical reasons, land related to religious and spiritual facilities is used to hook up with elements dissatisfied with the regime, opportunists in the country as well as exiles abroad, spreading distorted information on social media channels.

On news sites such as Radio Free Asia, VOA Vietnamese, social networking sites of the terrorist organization Viet Tan, etc., many articles have been published with arguments that distort the nature of the problem, exaggerating some individual phenomena; thereby, equating some limitations and weaknesses in state management of land.

In fact, the argument to abolish the regulation of public ownership of land is just a trick in the strategy of "peaceful evolution"of hostile forces, aiming to sabotage the development of our country. They want to take advantage of the land issue to create complicated "hot spots", aiming to divide the great national unity bloc, divide religions, cause disorder and instability in many places. At the same time, they cause confusion among a part of the people who are suffering from unwanted impacts in the process of mobilizing land resources for socio-economic development. From there, they carry out their plot to destabilize political security, order and social safety.

Reactionary forces are trying to carry out the plot to eliminate the concept of public ownership of land, in order to eliminate the solid foundation for implementing the democratic regime of the people, by the people, for the people. When land is privatized, it will lead to speculation, and forces can seize and accumulate land among a few members of society. Therefore, it will increase social division and disorder, especially in rural areas, remote areas. From there, it will cause confusion and division among the people, sow doubts and reduce people's trust in the correct leadership of the Communist Party of Vietnam.

Public ownership of land is an objective necessity.

Most countries in the world (regardless of political regime) consider land as a special national resource, an important resource for national development, related to all members of society. Although the way of management and the form of determining land ownership are different in each country, in essence, the State always manages land. Developed countries such as the US, China, France, Russia, etc. all affirm the increasingly important role and decisive position of the State in land management. The State's decision-making rights include: The right to decide on land use planning and plans, the right to regulate urban architectural planning and construction works; the right to regulate land use purposes; the right to handle disputes over land use rights and the right to issue regulations on land finance; the right to reclaim privately owned land to serve public interests on the basis of fair compensation for those whose land is reclaimed, etc.

In Vietnam, land is owned by the entire people and the State is the representative owner and manages it uniformly.It is an objective necessity and the most correct and effective method for the country's development.

The regime of public ownership of land in our country was first recognized in the 1980 Constitution:“Land, forests, mountains, rivers, lakes, mines, natural resources underground, in the sea and on the continental shelf, state-owned industrial, agricultural, forestry, fishery and commercial enterprises… are all owned by the people.”The 2013 Constitution continues to stipulate:“Land, water resources, mineral resources, resources in the sea, airspace, other natural resources and assets invested by the State, management of public assets owned by the entire people, represented by the State as owner and uniformly managed”.

At the 13th National Congress, our Party proposed a policy to continue reviewing and perfecting institutions on land management and use to suit the new development situation. The 5th Central Conference, 13th tenure also issued Resolution No. 18-NQ/TW, dated June 16, 2022."On continuing to innovate and perfect institutions and policies, improving the effectiveness and efficiency of land management and use, creating momentum to turn our country into a developed, high-income country"; which clearly states the point of view:“Land is owned by the entire people and is represented and uniformly managed by the State.”

According to current law:“Land is owned by the entire people and is represented by the State as the owner and managed uniformly. The State grants land use rights to land users according to the provisions of this law.”(Article 4, Land Law 2013)Accordingly, people or land users have many rights and benefits from land use such as: Being protected by the State regarding land use rights, enjoying the fruits of labor and investment results on land; having the right to convert, transfer, lease, sublease, inherit, donate, mortgage, contribute capital for land use rights; being compensated when the State reclaims land... These rights are exercised within the prescribed limits such as: Using land for the correct purposes prescribed by the State; not being allowed to arbitrarily change the land use purpose; The State has the right to reclaim the land use rights that have been assigned with compensation...

Thus, determining the regime of ownership of land by the entire people with the State as the representative owner is objective, consistent with the orientation of building a socialist rule-of-law state in Vietnam, reducing the risk of depleting land resources, curbing inequality in society; creating an important legal basis and tool for state management of land, especially in implementing policies on economic and social development, ensuring national defense and security. The fact that a small number of officials and civil servants commit violations in land management is due to their own degeneration and corruption, not properly implementing the principle that land belongs to the entire people with the State as the representative owner and unified management.
