Many real estate 'giants' in Nghe An owe land use fees
(Baonghean.vn) - Although the tax authorities have urged in many ways, issued notices of land use debt and late payment fees... but up to now, there are still some enterprises that have not paid money to the state budget.
Up to now, in Vinh city, there are 24 projects (including 4 social housing projects exempted from land use fees) for which the tax authority has established a set of project land use fees with the total amount announced according to Decision 80/2014/QD-UBND being 307.6 billion VND. The amount of land use fees paid to the state budget: 197 billion VND.
Thus, the amount of land use fee not yet paid to the state budget is 110 billion VND. Of which, there are 03 projects that have completed the procedures, past the deadline as announced but the enterprises have not yet paid the land use fee to the state budget with a total debt of more than 75 billion VND. They are: BMC Construction and Installation Materials Company Limited, investing in a project in Quan Bau Ward, Vinh City, with a debt of 33 billion VND; overdue payment as of April 8, 2016 is more than 7.5 billion VND. Dong A Joint Stock Company branch has a commercial and service housing project in Hung Binh Ward, Vinh City, with a debt of nearly 26 billion VND; overdue payment as of March 31, 2016 is nearly 1.2 billion VND. Construction Investment Joint Stock Company 492, a commercial service area project with housing and office building in Le Loi Ward, Vinh City, owes more than 9.6 billion VND, along with more than 100 million VND in late payment as of March 31, 2016.

The representative of the Real Estate Project Management Board of BMC Construction and Installation Company Limited said: The project has been implementing compensation and site clearance since 2008, but up to now, Mr. Minh Hong's household has not yet completed compensation.
The company agreed to compensate 9.3 billion VND but the family has not accepted, leading to the company currently being stuck with the above land area. The company committed that when the site clearance is completed, the company will pay the full land use fee.
In fact, some investors have delayed and failed to complete land allocation procedures according to Decision 80/2014/QD-UBND to delay paying land use fees. Enterprises are in debt for land use fees, causing real estate buyers in these projects to have their rights "suspended".
Therefore, there are currently 18 projects for which the tax authority does not have enough data to issue a notice of land use fee payment according to Decision No. 80/2014/QD-UBND. Of which, 08 projects do not have a land allocation decision or a land price decision from the Provincial People's Committee; 06 projects have a land allocation decision but do not have a land price decision from the Provincial People's Committee; 04 projects have a land price decision but do not have a land allocation decision from the Provincial People's Committee.

Mr. Nguyen Viet Hung - Deputy Head of Vinh City Tax Department said: For enterprises that owe land use fees, the Tax Department has urged them by calling many times, issuing notices of land use fees and late payment fees. The Department has directly worked with each enterprise with a record requesting enterprises with overdue debts according to the notice to immediately pay the remaining land use fees and late payment fees to the State budget and requesting a commitment to pay land use fees attached. However, up to now, there are still some enterprises that have not paid money to the State budget.
For Enterprises that do not have enough data for the tax authority to issue a notice, the Department has sent an Official Dispatch to Enterprises, and at the same time has a working record requesting Enterprises to directly work and provide project documents to the Department of Natural Resources and Environment and relevant agencies to promptly advise the Provincial People's Committee to simultaneously issue the Land Price Decision and the Land Allocation Decision of the project according to the provisions of the 2013 Land Law.
Recently, in the Conclusion Notice No. 225/TB-UBND dated April 20, 2016, the Chairman of the Provincial People's Committee requested to collect additional budget for urban real estate projects. Accordingly, land use fees for urban real estate projects in the group of projects eligible to pay land use fees but have not paid or still owe land use fees, projects must pay land use fees.
As for the BMC Vinh Plaza project in Quan Bau ward, invested by BMC Construction and Trading Materials Company Limited, the Tax Department is assigned to collect land use fees for the allocated land area, and to preside over and coordinate with the Department of Finance to consider and resolve the company's recommendations. For projects that have not fulfilled their financial obligations due to problems in the settlement of land use fees, the Tax Department is assigned to preside over the resolution. The Chairman of the Provincial People's Committee also requested that the above work must be completed by May 15, 2016 at the latest.
