According to the reporter's research, up to now, Nghe An province, like many other provinces in the country, has arranged for both civil servants and public employees to work in the Department of Education and Training. On September 9, 2002, the Government Organization Committee (now the Department of Home Affairs) and the Department of Education and Training issued Instruction No. 1013, which stipulates that the Department of Education and Training of each district, city, and town shall arrange from 5 to 7 state management positions (civil servants) in the total number of positions of the People's Council and People's Committee at the district level and annually assign each Department of Education and Training from 8 to 10 officials, so each department has 15 to 17 civil servants and public employees.

On December 2, 2011, the Ministry of Education and Training issued an official dispatch on the implementation of Decree 115/2010/ND-CP of the Government and Joint Circular No. 47/2011/TTLT-BGD&DT-BNV of the Ministry of Education and Training and the Ministry of Home Affairs, which determined the minimum number of staff for the Education and Training Department according to job position to be 18 people. Meanwhile, in reality, each Education and Training Department only has from 2 to 6 civil servants; The civil servant staff of the People's Council and the District People's Committee is assigned an average of 70 - 90 positions, so it is impossible to arrange enough 18 civil servant positions for the Education and Training Department at this time; in order for the Education and Training Department to complete its tasks, the District People's Committees have mobilized from 13 to 15 officials from schools to work at the Education and Training Department.

On April 15, 2012, the Government issued Decree No. 34/2012/ND-CP regulating the public service allowance regime (25%) for civil servants; The number of civil servants transferred to work at the Department of Education and Training are not eligible for public service allowances and although they still hold the professional title of teacher, they are not entitled to teacher allowances (preferential allowances, seniority allowances), leading to the desire of these civil servants to return to work at school to enjoy allowances.

In that situation, implementing Article 36 of the Law on Civil Servants, the Department of Home Affairs - Department of Education and Training advised the Provincial People's Committee to issue Official Dispatch No. 6612/UBND-TH dated September 24, 2012 on the staffing of the Department of Education and Training, requesting: The District People's Committee to develop a project to determine the structure and job positions of the People's Council and the District People's Committee, in which the unfilled staffing or staffing with retired or transferred civil servants is reserved for consideration to transfer the staffing to the Department of Education and Training with at least 9 civil servant positions.

In addition to the civil servant establishment, the Department of Education and Training is assigned from 4 to 8 officials on secondment from school units in the district. The seconded officials are assigned and managed by the Head of the Department of Education and Training; in addition to professional work, the seconded officials directly work as lecturers in training classes, providing professional training for the staff of the Education and Training sector, participating in training teams of excellent students, gifted students or participating in teaching some lessons at affiliated educational institutions; the seconded officials are entitled to salaries and allowances according to regulations for teachers (professional title of teacher) at educational institutions; the number of these people is included in the total number of employees assigned to the Education and Training sector at the district level.

The implementation of the arrangement of seconded officials according to the guidance in Official Dispatch No. 6612/UBND-TH dated September 24, 2012 has ensured the regime for employees, contributing to stabilizing and improving the quality of the staff working at the Department of Education and Training.

In addition, on August 30, 2019, the People's Committee of Nghe An province issued Directive No. 15 on implementing tasks for the 2019-2020 school year, accordingly directing: "Arrange jobs for leaders and specialists of the Department of Education and Training with sufficient staff; in places where jobs cannot be arranged, allow the transfer of managers and teachers of affiliated educational institutions to work at the Department of Education and Training and enjoy the working regime at schools in the central area".

If they do not have any allowances, it will create inequality in the regime among civil servants and public employees of the Department of Education and Training. They are not assured in their work, so many seconded officials have submitted applications to be assigned to work at their old schools with the positions they held before they were seconded; the Departments of Education and Training lack workers, affecting the management and professional guidance of the sector to meet the requirements of innovation and improve the quality of education. Due to the requirements of comprehensive educational innovation, the tasks assigned to the Department of Education and Training are increasingly numerous and heavy. In addition, the specific nature of the work of the Education and Training sector, management over a large area, large scale of schools and classes (more than 1,500 school units and 1,170 separate schools), many educational institutions in remote areas, so the implementation of the tasks of guidance, inspection, examination, professional training, topics... of the Department of Education and Training to educational institutions really needs more human resources.
