Many violations in outdoor advertising activities in Nghe An

Besides meeting the needs of businesses and society, outdoor advertising activities in the province are still subject to some violations, affecting management and ensuring urban aesthetics.

There are still ads that violate the regulations.

As one of the central wards of Vinh city, Hung Binh ward has bustling business activities, along withsignboard, billboardwith full size and content.

Mr. Nguyen Phuc Trang - Vice Chairman of the Ward People's Committee said: To enhance the effectiveness of state management, promptly correct shortcomings, and strictly handle violations, the Ward People's Committee has issued documents to implement the management of advertising activities in the ward.

From 2020 to present, the ward has carried out a campaign to dismantle and confiscate more than 80 billboards, billboards, 170 flags, and 35 banners that violated urban order and did not have a license.

However, the inspection, punishment and handling of violations related to outdoor advertising activities are still not timely and not complete; there are still many organizations and individuals hanging and pasting classified ads on walls, electric poles, trees, etc., while the results of handling administrative violations related to this content are still few; there are still signs that have expired or were installed without a license but have not carried out procedures to extend the time of use and repair and dismantle them in time. The placement of signs and billboards on sidewalks is still taking place, causing disorder and disturbing the urban beauty, especially on major roads such as Le Hong Phong, Nguyen Thi Minh Khai, Nguyen Sy Sach, Nguyen Van Cu, Doc Thiet, Kim Dong..."

Not only in Vinh city, in some districts such as Nghi Loc, Nam Dan, Do Luong, there are still violations of regulations on outdoor advertising. Mr. Nguyen Dinh Duong - Deputy Head of the Department of Culture and Information of Nghi Loc district said: "Outdoor advertising activities in the district are mainly concentrated in Quan Hanh town and in recent years there have been some violations related to this activity, such as some households have not complied with the size of advertising signs; signs still encroach on sidewalks; the situation of hanging and pasting classified ads on walls, electric poles, trees still occurs in many places...".

According to Mr. Nguyen Vo Long - Deputy Chief Inspector of the Department of Culture and Sports, from 2021 to present, the Department Inspectorate has organized inspections of billboards, signs, banners, flags, and advertisements on means of transport... Through inspections, a number of violations were discovered such as: Not notifying about the content, time, location of billboards, and the number of billboards; hanging signs, boards, and banners without a written notice approving the advertising content of the Department of Culture and Sports; incorrectly notifying the advertising content on banners to the competent State agency where the advertising is carried out; advertising on the front and back of means of transport; advertising by loudspeakers and other similar forms mounted on means of transport and mobile vehicles in the inner cities and towns of cities and towns...

From 2021 to present, the Inspectorate of the Department of Culture and Sports has sanctioned 16 establishments violating the provisions of the law on outdoor advertising activities, with a total fine of more than 120 million VND, and at the same time, applied measures to remove the violating advertising content.

Most recently, in early November, SAVANI International Fashion Company Limited was fined VND20 million for not notifying the content, time, location, and number of billboards; and Hoang Anh Performing Arts Company Limited was fined VND6 million for advertising using loudspeakers and other similar forms mounted on means of transport and mobile vehicles in inner cities and towns.

Improve the effectiveness of state management

According to statistics from the Department of Culture and Sports, there are currently more than 90 advertising businesses and establishments in the province. Advertising activities are mainly concentrated in Vinh city, on National Highway 1A and in densely populated areas, towns and cities.

Ms. Quach Thi Cuong - Deputy Director of the Department of Culture and Sports said that, implementing the Law on Advertising, the Department of Culture and Sports has organized propaganda work, advised on the issuance of many documents to effectively implement legal regulations on advertising activities, such as: Decision No. 47/2018/QD-UBND dated November 27, 2018 on amending and supplementing a number of articles of the regulations on construction and installation of outdoor advertising and propaganda means in Nghe An province; Decision No. 3149/QD-UBND dated October 2, 2023 on approving the Outline of tasks to adjust and supplement the Planning of the outdoor advertising and propaganda system in Nghe An province, period 2024 - 2030, orientation to 2040.

The Department also issues directives and instructions; inspects and examines the implementation of advertising management activities in the area; advises on reviewing administrative procedures, creating favorable conditions for organizations and individuals to participate in advertising activities in the province.

However, in recent times, there have been some limitations in advertising activities in the province such as: Unannounced or expired advertisements that are not removed, classified ads, and improper installation... affecting management and ensuring urban aesthetics.

Through practical research in localities, the work of inspection, examination and punishment still has many limitations. According to Mr. Nguyen Dinh Duong - Deputy Head of the Department of Culture and Information of Nghi Loc district: "The biggest difficulty now is that the staff doing state management work in this field at the grassroots level is still small, lacking experience, mainly holding many concurrent positions, not meeting the requirements of the job. Also due to the small force, in the district, we can only conduct one inspection of outdoor advertising activities per year and can only do it in Quan Hanh town".

“Currently, the force doing inspection and examination work is still small compared to actual needs, the coordination between sectors and some communes and wards is not really drastic, not proactive and not regular, so it is not possible to control all violations of some organizations and individuals in advertising activities in the city.”

To improve the effectiveness and efficiency of state management of outdoor advertising activities, the Department will focus on implementing adjustments and supplements to the Planning of the outdoor advertising propaganda system in Nghe An province for the period 2024 - 2030, with a vision to 2040 to ensure consistency and facilitate organizations and individuals participating in advertising activities; prioritize forms of advertising that apply modern technology; at the same time, review and advise on the issuance of regulations to thoroughly resolve and handle the problem of classified ads and advertisements that cause loss of aesthetics...
Strengthen inspection and timely handling of violations in advertising activities, clarify the roles and responsibilities of sectors and local authorities at all levels, especially wards, communes and towns, consider including criteria on rectifying advertising activities to consider recognition of meeting civilized urban standards.
