Important education policies coming into effect from December 2023
Starting in December 2023, several important education policies will come into effect.
Regulations on salary classification for civil servants supporting education for people with disabilities
On October 30, 2023, the Ministry of Education and Training issued Circular No. 21/2023/TT-BGDDT, stipulating codes, standards for professional titles and salary scales for civil servants supporting education for people with disabilities in public educational institutions. This Circular takes effect from December 16, 2023.
In particular, regarding the standards for training and fostering, civil servants supporting education for people with disabilities in public educational institutions must have a college degree or higher in a major supporting education for people with disabilities; or have a college degree or higher in one of the following fields, groups of fields, and occupations: Teacher training, Psychology, Social work, Health (according to regulations of the Ministry of Education and Training and the Ministry of Labor, War Invalids and Social Affairs). At the same time, complete the fostering program according to the professional title standards of civil servants supporting education for people with disabilities as prescribed.

According to the Circular, appointment to the professional title of civil servant supporting education for the disabled, code V.07.06.16, for the following 2 cases:
In case the officer is doing support workeducation for the disabledbut has not been appointed according to the provisions of Joint Circular No. 19/2016/TTLT-BGDĐT-BNV dated June 22, 2016 when meeting the standards on training qualifications specified in Point a, Clause 3, Article 3 of this Circular.
In case of being recruited to the position of civil servant supporting education for people with disabilities after the effective date of this circular and meeting the requirements for internship as prescribed.
Regulations on job positions in public general and specialized schools
On October 30, 2023, the Ministry of Education and Training issued Circular No. 20/2023/TT-BGDDT, providing guidance on job positions, staff structure by professional title and quotas for the number of employees in public general education institutions and specialized schools. This Circular takes effect from December 16, 2023.
The list of job position frameworks is divided into 4 groups according to the provisions of Decree No. 106/2020/ND-CP and Circular No. 12/2022/TT-BNV dated December 30, 2022 of the Ministry of Home Affairs, including:
Group of leadership and management positions (principal; vice principal). Group of specialized job titles (teacher, education officer, support for the disabled, etc.). Group of specialized job titles used in common according to the Circular of the Ministry of Home Affairs (accountant, clerk, treasurer, etc.) and group of support and service positions (security, service, school health, etc.).
Circular adds 1 position of student counselor in high schools to perform tasks related to student counseling in high schools.
Regulations on zoning to calculate teacher quotas
Based on the regional division regulations, the Provincial People's Committee directs specialized agencies to determine commune-level units in each region as the basis for calculating teacher quotas for general education institutions.
In special cases where the number of students per class must be lower or higher than the regional average prescribed in Clause 2 of this Article, the Provincial People's Committee shall decide on the number of students per class appropriate to reality.
Determining the structure of civil servants according to professional titles is carried out according to the provisions of Clause 5, Article 3, Clause 3, Article 4 of Decree No. 106/2020/ND-CP.
Regulations on job positions in public kindergartens
On October 30, 2023, the Ministry of Education and Training issued Circular No. 19/2023/TT-BGDDT, providing guidance on job positions, staff structure by professional title and quotas for the number of employees working in public preschools. This Circular takes effect from December 16, 2023.
According to the Circular, each public preschool is assigned one principal. The number of vice principals is implemented according to the regulations on the number of deputy levels in Decree No. 120/2020/ND-CP dated October 7, 2020 of the Government regulating the establishment, reorganization, and dissolution of public service units.

For groups of children: For every 15 children/group of children from 3 months to 12 months old; 20 children/group of children from 13 months to 24 months old; 25 children/group of children from 25 months to 36 months old, there will be a maximum of 2.5 teachers/group of children.
For kindergarten classes: For every 25 children/class from 3 to 4 years old; 30 children/class from 4 to 5 years old; 35 children/class from 5 to 6 years old, a maximum of 2.2 teachers/class is arranged.
For preschools that do not have enough children to arrange into groups or kindergarten classes according to the above regulations; or after arranging groups or kindergarten classes according to regulations but still have a surplus of children, the preschool teacher quota will be calculated based on the average number of children by age of each group or kindergarten class as follows:
For every 6 children aged 3 to 12 months or 8 children aged 13 to 24 months or 10 children aged 25 to 36 months, 11 children aged 3 to 4 years or 14 children aged 4 to 5 years or 16 children aged 5 to 6 years, an additional 1.0 teacher is assigned;
For schools with only 1 group of children or 1 kindergarten class that do not have enough children to arrange according to the prescribed group of children or kindergarten class, 2.0 teachers/group of children or kindergarten class will be arranged.
Regarding job positions supporting education for people with disabilities: Educational facilities with less than 20 children with disabilities studying in integration will be assigned 1 person; educational facilities with 20 or more children with disabilities studying in integration will be assigned a maximum of 2 people. When a group of children or kindergarten class has 1 child with disabilities studying in integration, the number of children in the group or kindergarten class will be reduced by 5 children. Each group of children or kindergarten class must not have more than 2 children with disabilities studying in integration;
In case it is not possible to arrange staff to perform the task of supporting education for people with disabilities, then arrange labor contracts or part-time teachers.
Preschools are assigned 2 people to perform accounting, clerical, cashier, and library duties.
For preschools with 5 or more schools or 15 or more groups of children or kindergarten classes, 3 people must be assigned to perform accounting, clerical, cashier, and library duties.
Preschools must arrange at least 1 contract worker to perform school health duties, at least 1 contract worker to perform security duties, and at least 1 contract worker to perform service duties. Based on the nature, workload, and actual conditions, preschools must determine the number of contract workers for each support and service position.
Preschools with boarding facilities are assigned contract workers to perform cooking tasks for children. Based on the number of children, workload and actual conditions, preschools determine the appropriate number of contract workers to perform cooking tasks.
Signing of labor contracts is carried out in accordance with current regulations of law./.
