Special cases of recruitment of commune-level civil servants without examination or selection
Based on the conditions for registering for the recruitment of commune-level civil servants and job requirements, district-level People's Committee Chairmen are recruited without examination or selection in some special cases.
Recruitment without examination or selection
Decree 34/2019/ND-CP amends and supplements a number of articles of Decree 112/2011/ND-CP dated December 5, 2011 of the Government on civil servants at commune, ward and town levels, including amending and supplementing special cases in recruitment.
Specifically, based on the conditions for registering for the recruitment of commune-level civil servants and job requirements, the Chairman of the District People's Committee is recruited without examination or selection in the following special cases:
- University graduates with excellent or higher grades in the country or good or higher grades abroad with expertise and skills suitable for the civil servant position to be recruited.

- People with university degrees or higher with majors suitable for the civil servant position to be recruited, have paid compulsory social insurance and have at least 5 years of work experience in the field to be recruited.
- Commune-level civil servants elected to hold positions defined as commune-level cadres, when they cease to hold the position (not during the disciplinary period), will be considered and accepted back by the Chairman of the District People's Committee. In case there is no longer a position for a commune-level civil servant, the regime and policies will be resolved according to the provisions of law.
In case a person recruited to become a commune-level civil servant according to the provisions of this Decree is assigned a position according to the training major or the previous professional expertise, the working period with compulsory social insurance payment before the date of recruitment or acceptance into the civil service (if there is a working period with compulsory social insurance payment that is not continuous and has not received a one-time social insurance subsidy, it will be accumulated) will be calculated as a basis for assigning a salary appropriate to the recruited civil servant position.
Must establish an examination and evaluation council.
In the recruitment of commune-level civil servants in the above special cases, the Chairman of the District People's Committee must establish an Examination and Assessment Council. Specifically, the Examination and Assessment Council has 5 or 7 members, including: The Chairman of the Council is the Chairman or Vice Chairman of the District People's Committee; 1 member is the head of the Department of Internal Affairs, concurrently the Secretary of the Council; 1 member is the Chairman or Vice Chairman of the Commune People's Committee where the civil servant is expected to be assigned after being accepted; other members are representatives of a number of related professional and technical departments.
The examination and assessment council is responsible for examining the conditions, standards, diplomas and certificates required for the civil servant position to be recruited; examining the general knowledge level and professional and technical capacity of the proposed candidate.
The form and content of the examination are determined by the Examination and Assessment Council based on the requirements of the civil servant position to be recruited, reported to the Chairman of the District People's Committee for consideration and decision before organizing the examination; The Examination and Assessment Council works on the principle of collective, majority voting and self-dissolution after completing its tasks.
