Jealousy when wife sits on the back of another man's motorbike

On November 12, Nguyen Quoc Long (57 years old, Thuy Phu commune, Huong Thuy town) was sentenced by the People's Court of Thua Thien Hue province to 17 years and 6 months in prison for the crime ofKilling, according to Point n, Clause 1, Article 123 of the 2015 Penal Code.

According to the indictment, at around 10:20 p.m. on May 1, 2019, Mr. Long saw Mr. Kim Khac Hieu (Truong An ward) driving a motorbike carrying Ms. Doan Thi Kim Chi (Long's estranged wife) through Thuy Phu commune (Huong Thuy town), so he sped past and blocked the vehicle. Mr. Long took out his phone to take a photo with the intention of saving evidence, but Mr. Hieu brushed it off, saying he did not agree.

When Mr. Hieu explained that he did not know Ms. Chi and was only giving her a ride home, Mr. Long did not believe him and used his hand to hit her. Mr. Hieu blocked the blow but did not fight back, then left.

Mr. Long opened the trunk of his motorbike, took out a 13cm long knife and stabbed Mr. Hieu three times, causing his death. After committing the crime, he put the knife in the trunk of his motorbike, stopped at the scene and was arrested by the police, who recorded him as red-handed.

At the trial, Mr. Long claimed that the victim and his wife had a romantic relationship. The crime was committed out of jealousy.

However, the prosecutor said that the deceased should not be blamed, the defendant had disregarded the law, disregarded the lives of others, and was too hooligan. The prosecutor withdrew the mitigating circumstance of Long's honest confession, and proposed an 18-year prison sentence.

The court assessed that the defendant had confessed honestly and had influenced his family to partially remedy his civil liability, so it considered mitigating circumstances and sentenced him to 17 years and 6 months in prison. Long must compensate the victim's family 369 million VND.
