Expired cars still in circulation will be fined from 4 to 6 million VND

From January 1, 2018, nationwide, there will be 24,439 cars that have expired their usage period according to the provisions of Decree 95/CP dated October 30, 2009 of the Government (regulating the usage period for cargo and passenger cars), including 2,632 passenger cars and 21,807 cargo cars.

The Vietnam Register (Ministry of Transport) has published a list of vehicles that have expired nationwide, as well as vehicles that will expire from January 1, 2018, on the website www.vr.org.vn in the sections "Vehicles that have expired" and "Vehicles that are about to expire" to assist authorities and people in searching and preventing "expired" vehicles from participating in traffic.

According to Decree 95/CP, the permitted period of participation in traffic for passenger vehicles is no more than 20 years (calculated from the year the vehicle was first manufactured), for cargo vehicles no more than 25 years and no more than 17 years for cars converted from other types of vehicles to passenger cars before January 1, 2002.

Head of the Department of Motor Vehicle Inspection (Vietnam Register) Ngo Hong He said that vehicles that have expired their usage period always pose a high risk of causing traffic accidents. The Road Traffic Law strictly prohibits the use of expired vehicles on the road and the obligations of owners of expired vehicles.

According to Circular No. 15/2014/TT-BCA dated April 4, 2014 (regulations on vehicle registration) of the Ministry of Public Security, vehicles that have expired their use period are subject to revocation of their vehicle registration certificates and license plates. Vehicle owners only need to bring their registration certificates and license plates to the registration management agency to submit them without having to bring their vehicles.

If the vehicle owner does not voluntarily submit within 15 days from the date of notification, the registration management agency shall coordinate with the commune-level police to revoke the vehicle registration and license plate.

Therefore, Decree No. 146/CP of the Government stipulates administrative penalties for violations in the field of road and railway traffic. Drivers who are detected and arrested by the authorities will be fined from 4 to 6 million VND, have their vehicles confiscated, and have their driving licenses revoked for 1 to 3 months.
