Mr. Hoang Quoc Viet - Director of Nghe An Department of Agriculture and Environment explains the adjustment of the new land price list.

The discussion session at the hall of the 31st session of the 18th Provincial People's Council, term 2021 - 2026 took place on the afternoon of July 9. Director of the Department of Agriculture and Environment Hoang Quoc Viet explained many issues under the management of the industry, including the content of adjusting the new land price list, which has recently been of interest to voters and people in the province.

Adjusting the new land price list according to the provisions of the 2024 Land Law

According to Director of Nghe An Department of Agriculture and Environment Hoang Quoc Viet: The 2024 Land Law takes effect from August 1, 2024, Clause 1, Article 257 clearly stipulates: During the time the 2024 Land Law takes effect until December 31, 2025; People's Committees of provinces and cities nationwide will adjust the land price list based on the provisions of the Law.

For Nghe An province, the land price list was developed in 2019 based on the 2013 Land Law, adjusting 8 contents. The 2024 Land Law stipulates more adjustments with 11 contents; including contents that if applied according to the land price list issued in 2019, will be inappropriate, making it impossible to implement investment projects in the area. Because the 2019 land price list is developed according to the upper and lower land price list framework issued by the Government; while the 2024 Land Law requires the development of a land price list in the direction of approaching market prices.

During the implementation process, projects in the province need a new land price list to allocate resettlement land, allocate land without collecting land use fees, determine the starting price for auctioning land use rights, apply for one-time land allocation... Therefore, it is required to adjust the land price list to comply with the 2024 Land Law; at the same time, to minimize the impact of adjusting the new land price list on people and businesses, the industry has calculated very carefully, the land rent of businesses ensures the highest increase of 10 - 20% (except for sudden changes due to previous errors in building inappropriate price lists or new roads built later).

Accordingly, the industry has advised the Provincial People's Committee to submit to the Provincial People's Council to adjust the ratio of commercial and service land from 55% to 20%; adjust land for production and business establishments from 50% to 20%; and mineral land from 100% to 40%.

According to comrade Hoang Quoc Viet: The most affected issue is people changing land use purposes, both affected by the new adjusted land price list and the Government's decree. Previously, according to Decree 45 of the Government guiding the implementation of the 2013 Land Law, the regulation on changing the land use purpose of gardens and ponds attached to residential land plots only required payment of 50% of the land use purpose conversion fee. Meanwhile, Decree 103 of the Government guiding the implementation of the 2024 Land Law requires payment of 100% of the area of ​​land use purpose conversion.

Currently, Nghe An province, along with a number of localities nationwide, have proposed that the Government amend this content; currently, the Ministry of Finance - the agency in charge of advising the Government to issue a Decree amending Decree 103 - has included in the draft amendments to the regulation on changing the purpose of using garden and pond land attached to residential land plots to 50% as before.

Explain many issues in the management field of the industry

The Director of the Department of Agriculture and Environment also explained the opinions of the Provincial People's Council delegates through the summary at the group discussion session on the slow progress of the Lan Chau North Island Resort Project in Cua Lo ward. Although it has been extended many times, the land has not been put into use, affecting the landscape, environment and investment opportunities for tourism development in Cua Lo.

According to information provided by Director Hoang Quoc Viet: The North Lan Chau Island Resort Project in Cua Lo Ward is invested by Golden City Joint Stock Company. The project is authorized to lease land and is granted a land use right certificate with a total area of ​​94,972.7m2.2. Up to this point, the project has not yet implemented construction of the project items according to the approved planning; the project has not been extended the land use progress. Currently, based on the direction of the Provincial Party Committee Standing Committee, the Southeast Management Board has established an inspection team, reviewed the entire project and reported to the Standing Committee for partial adjustment of the planning and extension of the land use progress.

The Director of the Department of Agriculture and Environment also received feedback from Xoi Voi village, Nhon Mai commune (formerly Tuong Duong district) that there are 20 households at high risk of landslides, and requested to relocate and resettle to ensure the safety of the people; at the same time, requested the local government of Nhon Mai commune to make a proposal, on that basis, the Department of Agriculture and Environment is responsible for appraising and submitting to the Provincial People's Committee for approval and implementation.

Explaining the issue of compensation for land clearance for National Highway 1A, Director Hoang Quoc Viet emphasized: With the responsibility of the industry, we will continue to coordinate with the Department of Finance, the Department of Construction and localities to focus on solutions to speed up the settlement of petitions as well as the approval of payments for households benefiting from the expansion of National Highway 1A. The Department also advised the Provincial People's Committee to direct and assign localities to establish teams to review and resolve petitions to respond to people, and at the same time establish a compensation council for land clearance to review and approve eligible cases and promptly pay the costs to people.

The Director of the Department of Agriculture and Environment also explained the problems and errors in cadastral map measurement data and cadastral measurement extracts in localities in the province; implementation of land administrative procedures according to the 2-level government model; the establishment and coordination relationship between the commune-level compensation and site clearance council and the investor to ensure efficiency; the clean water plant project in Quynh Tho commune, old Quynh Luu district...
