The Procuracy assessed that Mr. Son was the head of the most important ministry of the state, but he was greedy for material gain, corrupted morally, and committed a particularly serious crime. Due to personal interests, he directed his subordinates at MobiFone to commit violations in purchasing AVG shares. He must take responsibility as the leader and bear the highest responsibility, giving decisive instructions that forced his subordinates to comply.
After the case, he also received a bribe of 3 million USD from Pham Nhat Vu, which is an exceptionally large amount of money and the highest compared to other defendants. He had mitigating circumstances such as having many certificates of merit from the Government, ministries, and a second-class labor medal, etc. However, during the trial, he denied the act and then admitted it.

In contrast to Mr. Son, the People's Procuracy requested the panel of judges to consider mitigating circumstances for former Minister Truong Minh Tuan due to his many achievements in work and honest testimony. According to the People's Procuracy, Mr. Tuan signed many documents against regulations to promote MobiFone's purchase, including Decision 236 approving the project, leading to a loss of nearly 6,600 billion VND. However, the signing was due to "forced circumstances". Mr. Tuan was also the one who received the least bribes among the four defendants.
