Must I register my child for permanent residence within 60 days of birth?
From 2025, must children be registered for permanent residence within 60 days of birth? This is a concern of Mr. Sam Van Hung (Que Phong commune, Nghe An province).
Reply: Pursuant to Clause 2, Article 7 of Decree 154/2024/ND-CP regulating residence registration for minors as follows:
Residence registration for minors
1In case a minor registers permanent residence or temporary residence at the permanent residence or temporary residence of his/her father, mother or guardian, the father, mother or guardian shall declare and confirm their opinions on the Residence Information Change Declaration Form.
In case a minor registers permanent residence or temporary residence at a place of permanent residence or temporary residence that is not the place of permanent residence or temporary residence of his/her father, mother or guardian, the father, mother or guardian shall declare and confirm their opinions on the Residence Information Change Declaration Form. In case the Court decides to assign the minor to the care and upbringing of his/her father or mother, the person assigned to care and upbringing shall declare and confirm their opinions on the Residence Information Change Declaration Form.
2.Within a maximum of 60 days from the date of birth registration of a minor, the father or mother, head of household or guardian shall be responsible for carrying out the procedures for permanent residence registration, temporary residence registration, and declaration of residence information for the minor. In case the minor's father or mother has a permanent residence but it is not the place where they are actually living, the minor shall be registered for permanent residence at the place of permanent residence of the father or mother.
3.In case the parents of a minor do not have both a permanent residence and a temporary residence, the minor's residence information must be declared according to the provisions of Article 4 of this Decree.
4.In case of first-time permanent or temporary residence registration for minors as prescribed in Clause 1 and Clause 2 of this Article, the residence registration authority is not required to check and verify the conditions regarding the legality of the accommodation and residence status.
From the above regulations, it can be seen that fathers, mothers or household representatives, guardians, and child caretakers are responsible for registering their children's residence (permanent or temporary) within 60 days from the date of birth registration./.
