How did Phan Van Vinh and Nguyen Thanh Hoa back the gambling ring?

Police general "backs" the "boss"

According to the representative of the People's Procuracy, while holding the position of Director General of the General Department of Police, Mr. Vinh took advantage of the Ministry of Public Security's permission to establish a front company under Department C50, signing and issuing a decision to recognize CNC company as a front company against procedures.

As the head of the agency assigned by the State to fight and prevent crimes in many fields, including high-tech crimes and social order, Phan Van Vinhmust be the person who understands best the criminal elements of organizing gambling and gambling crimes in order to have the responsibility to directly fight and guide subordinates.

However, after receiving Nguyen Van Duong's proposal to "pilot allowing users to convert part of their virtual accounts to virtual cards or CNC's e-wallets", meaning Nguyen Van Duong was proposing to publicly connect and serve card gambling games, on the same day Phan Van Vinh wrote: "Respectfully forward to the Director and the Department of High-Tech Crime Prevention Police to study and propose".

Based on Phan Van Vinh's instructions, Nguyen Thanh Hoa directed Mr. Luc to draft Official Dispatch No. 1155/C50-P1 dated May 20, 2016 for Nguyen Thanh Hoa to sign, proposing the above content to Phan Van Vinh for Phan Van Vinh to submit to his superiors.

On May 22, 2016, Phan Van Vinh wrote: "Agree to the proposal, assign the Director of the Department of High-Tech Crime Prevention to directly direct, control, organize and ensure the pilot activities and legal procedures are in accordance with legal requirements and control the situation of criminal activities in this field, and submit proposals to the General Department and the Ministry."

The above permission of Phan Van Vinh is completely contrary to the principles of combating high-tech crimes stipulated in Clause 2, Article 4 of Decree 25/2014/ND-CP dated April 7, 2014, which stipulates:

A particularly noteworthy sign of Phan Van Vinh and Nguyen Thanh Hoa's "backing" for Nguyen Van Duong to commit the crime of organizing gambling is that they let CNC Company rent their own headquarters at 10 Ho Giam to operate the gambling system; not only that, in the CNC Company's headquarters there is also an office with a sign reading: "Ministry of Public Security - Department C50; Office of Major General Nguyen Thanh Hoa - Department Director".

This has shown that the head of the agency with the highest authority in the fight against high-tech crimes has tolerated Nguyen Van Duong and his accomplices from committing crimes, while effectively preventing subordinate agencies or coordinating agencies from verifying and handling Nguyen Van Duong and his accomplices.

Phan Van Vinh's act of assisting Nguyen Van Duong and his accomplices in organizing gambling did not stop there, but he also signed a document requesting competent authorities to create favorable conditions for CNC Company's gambling organization activities;

At the same time, Mr. Vinh also directed Mr. Nguyen Thanh Hoa to sign a report proposing that CNC Company continue to organize gambling (operate the Tip.Club card game reward portal).

Second report, still not true

The leaders of the Ministry of Public Security discovered that CNC Company operated two card games, Rikvip.com and 23zdo.com, which were disguised gambling sites with signs of violating the law. They requested a report, but Phan Van Vinh did not comply with the instructions.

When the second document was issued after 50 days, the defendant directed the Department of High-Tech Crime Prevention and Control to advise on preparing a report to the leaders of the Ministry of Public Security. The subject reported untruthfully and did not direct the prevention of gambling organization but also directed Mr. Nguyen Cong Son - Deputy Director General of the General Department of Police to sign a document requesting the Ministry of Information and Communications to grant a license to operate gambling card games of CNC Company.

For his part, with the functions and tasks assigned by the Ministry of Public Security to fight and prevent high-tech crimes, Nguyen Thanh Hoa did not properly perform his functions and tasks, but directly advised Phan Van Vinh to establish a CNC front company contrary to the Decision of the Ministry of Public Security and the direction of the Ministry of Public Security's leaders.

At the same time, Mr. Hoa also requested the leaders of the General Department of Police to allow CNC Company to rent the headquarters at 10 Ho Giam, Dong Da, Hanoi.

Knowing that CNC Company was organizing gambling, he did not prevent or handle it, but Mr. Hoa also advised and issued documents to facilitate the organization of gambling, covering up and preventing the functional departments with the function of preventing high-tech crimes from verifying and handling,...

Defendant Nguyen Thanh Hoa stated that allowing CNC Company to organize gambling was to create "revenue from this pilot activity to be used for investment and building a national defense system against crime, which is a strategic task of C50".However, in reality, for more than two years, CNC Company organized online gambling, illegally profiting thousands of billions of VND, but no amount of money was invested in the national defense system against cybercrime, but only a very small amount compared to the total revenue (spending 700 million VND and a set of anti-virus software worth 30,000 USD) for C50./.
