Fines up to 100 million VND for violations in enrollment
The Government has just issued Decree 04/2021/ND-CP regulating administrative sanctions for violations in the field of education. Accordingly, the Decree stipulates that violations in enrollment can be fined up to 100 million VND.
Fines up to 40 million VND if enrollment is not carried out according to the announced plan
Specifically, regarding violations of regulations on enrollment organization, this Decree clearly states:
A fine of between VND 10 million and VND 20 million shall be imposed for one of the following acts: Announcing admissions or announcing admission plans with incorrect or incomplete information as prescribed by law; Announcing admissions within the time limit as prescribed by law.
A fine of 20 million to 30 million VND shall be imposed for one of the following acts: Announcing enrollment quotas exceeding the number prescribed for determinationenrollment targets; Not following the admission process as prescribed by law.

A fine of 30 million to 40 million VND shall be imposed for one of the following acts: Failure to announce the input quality assurance threshold for training majors that have specified quality assurance thresholds; Conducting enrollment not in accordance with the announced enrollment plan.
A fine of between VND40 million and VND60 million shall be imposed for organizing admission to foreign education programs, majors or fields without permission.
The remedial measure is to force the facilities to transfer eligible students who have been admitted to another educational facility that is eligible and permitted to operate.educationor cancel the admission decision, return the collected fees to the student if the transfer cannot be made for the violation.
Violation of regulations onadmission objectsmay be fined 100 million dong
The Decree also clearly states the penalties for violations of regulations on admission subjects.
Accordingly, fines for acts of recruiting university-level training for the wrong subjects are specified in the enrollment regulations at the following levels:
Fines from 10 million to 30 million VND for the act of wrongly recruiting less than 10 students;
Fines from 30 million VND to 70 million VND for the act of wrongly recruiting from 10 to less than 30 students;
Fines from 70 million to 100 million VND for the act of wrongly recruiting 30 or more students.

The Decree also stipulates fines for acts of recruiting students for master's and doctoral training programs that are not in accordance with the enrollment regulations according to the following fine levels:
Fines from 20 million to 40 million VND for the act of wrongly recruiting less than 5 students;
Fines from 40 million VND to 70 million VND for the act of wrongly recruiting from 5 to less than 10 students;
Fines from 70 million to 100 million VND for the act of wrongly recruiting 10 or more students.
In addition, a fine of 10 million to 20 million VND will be imposed on those who falsify or correct documents in the application file to be admitted but not to the extent of criminal prosecution.

Violations of enrollment quotas can be fined up to 80 million VND.
The Decree also clearly states the penalties for violations ofenrollment targets.
Accordingly, fines for acts of recruiting students for university training exceeding enrollment targets are as follows:
Fine from 5 to 10 million VND for recruiting more than 3% to less than 10%.
Fine from 10 to 30 million VND for recruiting more than 10% to less than 15%.
Fine from 30 to 50 million VND for the act of recruiting in excess from 15% to less than 20%.
Fines from 50 to 70 million VND for recruiting more than 20% of the total.
Fines for acts of recruiting students for master's and doctoral training exceeding enrollment targets are as follows:
Fine from 10 to 20 million VND for recruiting more than 3% to less than 10%.
Fines from 20 to 40 million VND for recruiting more than 10% to less than 15%.
Fines from 40 to 60 million VND for recruiting more than 15% to less than 20%.
Fines from 60 to 80 million VND for recruiting more than 20% of the total.
The remedy is to force the number of students recruited next year to be at least equal to the number of students recruited in excess of the quota.
This Decree takes effect from March 10, 2021 and replaces Decree No. 138 dated October 22, 2013 of the Government regulating administrative sanctions for violations in the field of education./.
