Speaking to reporters, Mr. Nguyen Van Tien, Chief Justice of the Military Court of the Capital Military Region, said that this unit has prepared the courtroom and arranged staff to be ready for the Military Court of Military Region 7 to open a trial of the case.
Regarding the reason why the Military Court of Military Region 7 did not try the case in Ho Chi Minh City but moved it here, Mr. Tien said he did not know. "According to the direction of superiors and the request of the Military Court of Military Region 7, we are just preparing the trial location. As for the issues related to the content of the case, it is not our business."
A source knowledgeable about the trial process said that it is normal for the case to be tried outside the court with jurisdiction. "Maybe in this case, the defendants are all detained in Hanoi, so for the convenience of the trial, it would be more convenient for the panel of judges from Military Region 7 to come here to try the case than to try it there. I think, in special cases like this, there will be close leadership from the Central Military Commission," the source commented.
Meanwhile, another source said that many employees of Thai Son Company, who were subordinates of defendant Dinh Ngoc He, were summoned to Hanoi to attend the trial as witnesses.
At the trial tomorrow, in addition to Dinh Ngoc He, four other defendants will also have to appear in court as accomplices. They are Tran Van Lam (former CEO of Thai Son Investment Development Joint Stock Company, Ministry of National Defense), Tran Xuan Son (former branch director in Binh Duong, Thai Son Investment Development Joint Stock Company) and Bui Van Tiep (former Division Commander of Division 367, Air Defense - Air Force). The three defendants are prosecuted for the crime of Abusing position and power while performing official duties.
In addition, the fifth defendant in the trial is Phung Danh Tham (former Chairman of the Board of Directors and General Director of Thai Son Corporation, Ministry of National Defense). Mr. Tham is the only defendant prosecuted for the crime of Lack of Responsibility causing serious consequences.
The prosecution agency determined that this was a case of complicity, in which Dinh Ngoc He played the role of initiator and directed other accomplices to commit the crime; Tran Van Lam, Tran Xuan Son and Bui Van Tiep played the role of executors and assistants in the crime of Abusing position and power while performing official duties.
