Permanent Vice Chairman of Nghe An Provincial People's Committee chaired the regular citizen reception session in August
On the morning of August 15, authorized by the Chairman of the Provincial People's Committee, Comrade Le Hong Vinh - Member of the Provincial Party Standing Committee, Permanent Vice Chairman of the Provincial People's Committee chaired the regular citizen reception session in August 2024.
Attending the citizen reception session were comrade Thai Thi An Chung - Member of the Provincial Party Executive Committee, Deputy Head of the Provincial National Assembly Delegation; representatives of the Provincial Fatherland Front Committee, leaders of Party committees, departments, branches and leaders of Vinh city.

Standing Vice Chairman of the Provincial People's Committee Le Hong Vinh received citizen Dang Truong Giang and households living at Vinaconex 16 apartment building, An Duong Vuong street, Truong Thi ward, Vinh city.
Mr. Giang proposed a number of contents related to the responsibility of the Tax authority in resolving complaints about opening invoices for Construction Joint Stock Company 16 - Vinaconex as a basis for procedures to apply for a Certificate of Land Use Rights for households at Vinaconex 16 Apartment Building, after Construction Joint Stock Company 16 - Vinaconex paid additional tax arrears at the end of 2023.

A representative of the provincial Tax Department said that Construction Joint Stock Company 16 - Vinaconex currently owes 14.7 billion VND in taxes, has its account frozen and is not allowed to use invoices.
Although at the end of 2023, this Company paid additional tax arrears and requested to open a single invoice, up to now, the company is still not eligible to open a single invoice.

At the meeting, a representative of Construction Joint Stock Company 16 - Vinaconex also explained and discussed some related issues and said that in the coming time, the company will mobilize resources to pay off all late payment fees and tax principal debt.
After listening to the opinions of the sectors, the Standing Vice Chairman of the Provincial People's Committee, Le Hong Vinh, shared with the households living in the Vinaconex 16 apartment building that although they have basically fulfilled their financial obligations, they have not yet been granted the Land Use Rights Certificate. The reason is that the apartment building investor has not fully fulfilled its financial obligations to the State.
To completely resolve the people's petition, the Standing Vice Chairman of the Provincial People's Committee requested the Provincial Tax Department to resolve the complaint in accordance with regulations and procedures.

Construction Joint Stock Company 16 - Vinaconex cooperates with the Provincial Tax Department to determine the total tax debt and outstanding financial obligations. On that basis, the Provincial Tax Department guides the enterprise to carry out procedures according to legal regulations, if necessary, seek guidance from the General Department of Taxation.
The Standing Vice Chairman of the Provincial People's Committee said that the Provincial People's Committee will issue a document requesting the Vietnam Construction and Import-Export Joint Stock Corporation - Vinaconex to coordinate in resolving the project's financial obligations in the province.

Next, Permanent Vice Chairman of the Provincial People's Committee Le Hong Vinh received Mr. Tran Huynh Dong, residing in Vinh Tien block, Hung Binh ward (Vinh city). Mr. Dong was authorized by Mr. Tran Giang Huong and Ms. Le Thi Ben, residing in block 5, Nghi Hoa ward, Cua Lo town.
Mr. Dong proposed that the competent authority consider and carry out procedures to change the land use purpose, separate the plot and donate the right to use land plot No. 85, map sheet No. 14, Nghi Hoa ward, Cua Lo town.

According to the case file, Mr. Tran Giang Huong and Ms. Le Thi Ben's household was granted a Certificate of land use rights by the People's Committee of Cua Lo town, code BT 355886, with an area of 2,417.2 square meters, of which 1,000 square meters is urban residential land and 1,417.2 square meters is garden land.
Mr. Huong's family filed a dossier to change the purpose of use of 400 m2 of garden land to residential land and on December 19, 2023, the Branch of the Land Registration Office of Cua Lo town was granted a Certificate of Land Use Rights, including 1,400.0 m2 of urban residential land and 1,017.2 m2 of garden land.

According to the People's Committee of Cua Lo town, the land plot that Mr. Huong and Ms. Ben are using is located in the Residential Land Planning Area on Street 21-22 - Location 1, Nghi Hoa Ward, which was approved by the People's Committee of Cua Lo town in Decision No. 4704/QD-UBND dated December 21, 2016.
According to the detailed 1/500 land division plan, most of his family's land was divided into residential plots; only 121.4 m2 of the remaining land was planned for roads. Mr. Huong's family did not follow the approved plan to carry out the land division procedure, so the Town People's Committee refused to do so.
In addition, after reviewing the land plot that the family is using, it is not included in the 2024 Land Use Plan of Cua Lo town approved by the Provincial People's Committee. Therefore, at present, the People's Committee of Cua Lo town has no basis to reclaim the land and allocate it to the family.

Concluding the solution, Standing Vice Chairman of the Provincial People's Committee Le Hong Vinh assigned Cua Lo town to coordinate with Vinh city, Department of Construction, Department of Natural Resources and Environment to study the reality, zoning plan to advise on adjusting the detailed plan 1/500, apply current regulations, create favorable conditions for people to change land use purposes.
Currently, the Department of Natural Resources and Environment has completed the draft Decision replacing Decision No. 28/2021/QD-UBND dated September 17, 2021; in which, there are regulations on the content of conditions, minimum area for land division and land consolidation for each type of land in Nghe An province. After the Provincial People's Committee issues the decision, organizations and individuals will have the basis to implement.
Standing Vice Chairman of the Provincial People's Committee Le Hong Vinh also received Mr. Nguyen Thanh Tung (son of Mrs. Pham Thi Nghia, residing in Kim Son hamlet, Nghi An commune, Vinh city). Mrs. Nghia requested the competent authority to consider and issue a Land Use Right Certificate and change the land use purpose for her family.

Previously, in 1999, the hamlet exchanged 760 square meters of agricultural land for 490 square meters of land belonging to Mrs. Nghia’s family to build a hamlet cultural house. The exchanged land plot was surveyed on a cadastral map in 2013 and registered in the inventory book.
However, according to the Vinh City People's Committee, comparing the zoning plan and land use plan approved by the competent authority, Ms. Nghia's land plot is not consistent with the agricultural land plan that has been planned for residential purposes. Therefore, the issuance of Land Use Right Certificates to citizens is facing difficulties.

After listening to the opinions of the sectors, the Standing Vice Chairman of the Provincial People's Committee, Le Hong Vinh, assigned the Vinh City People's Committee to review the history, origin of land use, and the land conversion process between the hamlet and Ms. Nghia's family regarding the area, time, and related documents.
The Standing Vice Chairman of the Provincial People's Committee assigned the Department of Natural Resources and Environment to coordinate with the Vinh City People's Committee, the Provincial Inspectorate, and the Department of Construction to study and advise on solutions to resolve citizens' petitions in accordance with current regulations. If necessary, the Provincial People's Committee will issue a document requesting comments from the Ministry of Natural Resources and Environment.
Standing Vice Chairman of the Provincial People's Committee Le Hong Vinh also asked Mr. Tung's family to actively coordinate with the sectors and authorities and provide complete documents to help the authorities resolve the petition, ensuring the legitimate rights of citizens.
