Permanent Vice Chairman of the Provincial People's Committee periodically receives citizens in August

Standing Vice Chairman of the Provincial People's Committee Le Hong Vinh received Mr. Phan Trong Nguyen (residing in Block 8, Trung Do Ward, Vinh City). Mr. Nguyen complained about the right to use 200m2land where the family is living and recommend that the competent authority cancel the planning project to build Cau Thong market so that the family can stabilize their life.
“The project was approved in principle for investment in 2005 but has not yet been implemented. The family’s house has not been repaired or rebuilt for many years. During the rainy season, the house leaks and the floor is damp. The family hopes that the competent authorities will resolve the matter and issue a Land Use Rights Certificate so that the family can soon build a house and stabilize their lives,” Mr. Nguyen requested.

Chairman of Vinh City People's Committee Tran Ngoc Tu said that during the process of handling the petition, Mr. Nguyen's family could not provide legal documents proving the origin of land use, so Trung Do ward confirmed that this was State land assigned to Anh Hong Urban Area for management since 1992. However, Trung Do ward later confirmed that Mr. Nguyen's family used the land after October 15, 1993.
Regarding the Cau Thong market project, on July 29, 2021, Vinh City sent an official dispatch requesting the Department of Planning and Investment to report to the Provincial People's Committee to consider two options.
Firstly, continue implementing the project on the condition that the investment registration certificate and detailed construction planning of the project are adjusted; remove area B of the project (including part of the land area where Mr. Nguyen's family is living) from the project scope before August 30, 2021. If the above deadline is exceeded, the State will reclaim the land and terminate the project.
Second, revoke and terminate the Cau Thong market project.

The Department of Planning and Investment said that the project was extended twice and the construction of the items was very slow, the land had been vacant for a long time. Regarding the proposal of Vinh City, the province has sent a document requesting Trang Anh Construction Production and Trade Joint Stock Company and Saigon LAND Corporation to urgently complete legal procedures to determine the project investor, but up to now, these two companies have not had any official documents.
After listening to the opinions of the sectors, the Standing Vice Chairman of the Provincial People's Committee, Le Hong Vinh, concluded that if Mr. Phan Trong Nguyen's family does not agree with the conclusion of Trung Do Ward (Vinh City) on determining the origin of land use, they can file an administrative lawsuit in court for resolution. Regarding the content of Mr. Nguyen's family's request to cancel the planning of the Cau Thong market construction project, the province will consider, decide and respond to citizens.

Mr. Thong reported that his family was granted a Certificate of Land Use Rights for a plot of land in Hamlet 13 by Vinh City, but Mr. Nguyen Van Phuc's family illegally built a car garage on the drainage system of 4 hamlets, resulting in Mr. Thong's family having no way to enter the house and having to borrow land from neighbors. Mr. Thong requested the competent authority to inspect, take measures to handle, and clear Mr. Phuc's illegally built garage and return the road to his family's house.
Vinh City People's Committee Chairman Tran Ngoc Tu said that the land area at Mr. Phuc's car garage has not been fully and precisely determined, because there are still many issues that need to be clarified. Mr. Thong's reflection that the car garage affects his family's travel is not accurate. Vinh City proposed that the Provincial People's Committee assign the city to establish a working group to conduct a field inspection to determine the current construction status.

Concluding the direction to resolve the case, Standing Vice Chairman of the Provincial People's Committee Le Hong Vinh assigned the Vinh City People's Committee to establish a working group to urgently inspect the origin of the land and the current construction status in the field, to promptly resolve the case according to regulations, and report the results to the Provincial People's Committee before September 30, 2021./.
