Plan to handle headquarters and public assets in Vinh City after the merger

Plan to arrange public assets in Vinh city according to Plan No. 236/KH-UBND to implement Resolution No. 1243/2024 of the National Assembly Standing Committee on the arrangement of district and commune-level administrative units in Nghe An province for the period 2023 - 2025.

Accordingly, the city stipulates: The arrangement, handling, and disposition of headquarters and public assets of administrative units subject to arrangement shall be carried out in accordance with Resolution No. 35/2023/UBTVQH15 of the National Assembly Standing Committee; Decree No. 167/2017/ND-CP and Decree No. 67/2021/ND-CP of the Government.

For other assets (including: cars, machinery, equipment, tools, instruments), continue to manage and use according to the standards and norms issued in Decree No. 04/2019/ND-CP dated January 11, 2019 of the Government, Decision No. 50/2017/QD-TTg dated December 31, 2017 of the Prime Minister and current legal regulations.

The arrangement, handling, management and use of public assets shall be carried out within 3 years from the effective date of the Resolution of the Standing Committee of the National Assembly on the arrangement of administrative units at all levels; on the basis of maximizing the exploitation of financial resources from the rearrangement and handling of housing and land facilities; ensuring timeliness, compliance with regulations, avoiding loss and waste.

* Handling of headquarters and public assets of Cua Lo town (old): The city conducts a review, inventory, and assessment of public assets of Cua Lo town (including headquarters and assets of Party agencies, government agencies, socio-political organizations of Cua Lo town and assets and headquarters of agencies and public service units under Cua Lo), carries out the handover and receipt of headquarters, assets on land, and other types of public assets when implementing the merger; at the same time, develops a plan and reports to competent authorities regarding the headquarters and surplus public assets of Cua Lo town according to the provisions of law.

* Arrange and set up headquarters, facilities, and necessary equipment to serve the activities of Vinh City People's Committee (after the merger): Conduct a review and assessment of existing public assets, organize the reception of new public assets to develop a plan to arrange and allocate working headquarters, facilities, and necessary equipment to ensure compliance with regulations and stable operations of the Vinh City People's Committee and affiliated public service units after the merger. Research and continue to arrange a "Team or Department for receiving and returning administrative procedure results" under the Office of the People's Council and People's Committee of Vinh City (new) on Nguyen Sinh Cung Street, Nghi Huong Ward to facilitate people's administrative transactions.

* Regarding the arrangement, layout and handling of public assets of wards and communes after merging into new administrative units: Conduct a review, assessment, and inventory of public assets of the wards subject to merger to develop a plan for arranging and assigning working headquarters for the new wards (after the merger), provide guidance on the handover and receipt of facilities, equipment, and public assets between the old and new administrative units. At the same time, advise the City People's Committee on a plan to handle headquarters and public assets (surplus) in wards and communes after the merger to ensure timeliness, compliance with regulations, and avoid waste and loss of assets.

* For engraving, registering the use of new seals and revoking old seals: Pursuant to the provisions of law and instructions of provincial departments and branches (Provincial Police, Department of Home Affairs), hand over the seals at the agencies and units of the old administrative unit and at the same time request the competent authority to engrave new types of seals and issue licenses to continue using the old seals for the agencies and organizations of the new administrative units at all levels (without changing the name).

Implementation time:Revoke the old seals at the end of administrative working hours on December 20, 2024.

After the old seal is revoked, new seals will be issued to new agencies and administrative units for use from December 23, 2024. In case of needing to handle backlog work, the seal of the new administrative unit will be allowed to be used for handling.

Article 13,Resolution 35/2023/UBTVQH15Regulations: The arrangement and handling of headquarters and public assets after the arrangement of administrative units at district and commune levels are regulated as follows:

Based on the overall plan for arranging local administrative units at district and commune levels, the Provincial People's Committee shall make a list and propose a plan for handling the headquarters and public assets of local agencies, organizations and units under its management, along with the project.

Ministries and central agencies with affiliated units in the administrative units at district and commune levels shall arrange, make a list and plan for rearranging and handling headquarters and public assets under their management. In case there is no need to use them, they shall transfer them to the People's Committee of the province where the headquarters are located for arrangement, management and use according to local needs.

Within 3 years from the effective date of the resolution of the National Assembly Standing Committee on the arrangement of each administrative unit, the rearrangement and handling of headquarters and public assets of agencies and units in the administrative unit after the arrangement must be completed.

The arrangement and use of headquarters and public assets after administrative unit reorganization shall comply with Government regulations on reorganization and handling of public assets.

Local authorities at all levels shall proactively balance and arrange budget resources to invest in repairing, renovating and upgrading working offices that continue to be used to serve the operations of administrative units formed after the arrangement in accordance with the planning and actual conditions of the locality.

Time limit for performing the above tasks: Within 3 years from the effective date of the Resolution of the National Assembly Standing Committee (Clause 2, Article 13, Resolution No. 35/2023/UBTVQH15).
