Management and use of funds collected from fines for violations of road traffic order and safety

The Government issued Decree 176/2024/ND-CP dated December 30, 2024 regulating the management and use of funds collected from administrative fines for violations of road traffic order and safety and vehicle license plate auctions after payment to the state budget.

This Decree provides for the preparation of estimates, management, use and settlement of funds; expenditure contents and levels for activities to ensure traffic order and safety for funds collected from handling administrative violations of road traffic order and safety and auctioning of vehicle license plates after payment to the state budget.

Accordingly, there are 18 regulations that are allowed to be spent by the Ministry of Public Security and 15 regulations that are allowed to be spent by the People's Committees of provinces and centrally-run cities. The Decree also stipulates the spending levels for officials directly involved in traffic safety activities.

The level of support for individuals and organizations providing information reflecting administrative violations of traffic order and safety in 01 case or incident shall not exceed 10% of the amount of administrative fine, maximum 5,000,000 VND/01 case or incident.

The expenditure levels for the expenditure contents specified in Articles 5 and 6 of this Decree are as follows:
1. The allowance for officers and soldiers directly involved in ensuring traffic order and safety at night shall not exceed VND 200,000/person/shift (1 shift of 4 hours or more, night work time from 10:00 p.m. the previous night to 6:00 a.m. the following morning), for half a shift (2 hours), the allowance shall not exceed VND 100,000/person, maximum 10 shifts/month.
2. The level of overtime allowance for cadres, civil servants, public employees and other local forces directly involved in ensuring traffic order and safety during the day shall not exceed VND 100,000/person/shift, maximum 10 shifts/month; for night shifts, not exceeding VND 200,000/person/shift (01 shift of 04 hours or more, night work time from 22:00 the previous night to 06:00 the following morning), 1/2 shift (02 hours) the level of allowance shall not exceed VND 100,000/person, maximum 10 shifts/month.
3. The level of support for individuals and organizations providing information reflecting administrative violations of traffic order and safety in 01 case or incident shall not exceed 10% of the amount of administrative fine, maximum 5,000,000 VND/01 case or incident.
4. Expenditure levels for other expenditure items are implemented according to legal regulations.
