Politburo's regulations on disciplinary action against party organizations and party members who violate
According to Regulation 69, party members who are being considered for disciplinary action by the party organization shall not be transferred, transferred, appointed, conferred, or promoted in military ranks; conferred, awarded, or recognized with titles of the Party or State.

On behalf of the Politburo,Standing SecretariatVo Van Thuong has just signed and issued Regulation 69 dated July 6, 2022 on disciplining party organizations and party members who violate the law.
Regulation 69 replaces Regulation No. 07-QDi/TW dated August 28, 2018 of the 12th Politburo on disciplinary action against violating party organizations and Regulation No. 102-QD/TW dated November 15, 2017 of the 12th Politburo on disciplinary action against violating party members.
The regulation has 4 chapters with 58 articles stipulating the content of violations and disciplinary measures for party organizations and party members who violate to the extent that disciplinary action must be taken.
Regulation 69 applies to party organizations (including party organizations whose term of operation has expired, have been dissolved, or have changed due to transfer, separation, or merger) and party members (including party members declared missing, and deceased party members who have committed particularly serious violations).
Caseparty organization,party member violationFor matters not mentioned in this Regulation, disciplinary action shall be taken in accordance with the Party's Charter and regulations, the State's laws, the Charter and regulations of the Fatherland Front, and socio-political organizations in accordance with this Regulation.
Regarding the principle of disciplinary action, the regulation clearly states that a violation is only disciplined once with one form of discipline.
When considering discipline at the same time, if there are two or more violations, each violation will be considered, concluded, and a common decision will be made with the highest form of discipline. Each violation will not be separated to apply different forms of discipline or to be disciplined multiple times.
After 12 months from the date of announcement of the disciplinary decision or the decision to resolve the disciplinary complaint (except for the disciplinary decision to expel a party member or the disciplinary decision to dissolve a party organization), if the party organization or party member does not complain, does not re-offend or does not commit new violations to the extent that discipline is required, the disciplinary decision will automatically cease to be effective.
Party organization discipline must clearly consider the organization's responsibility, and at the same time consider the responsibility of each individual involved in disciplining violating party members, especially the responsibility of the leader.
Also according to the regulations, the principle is that if a party member, after transferring jobs, quitting or retiring, discovers violations at his/her former agency or unit to the extent that discipline is required, he/she will be considered for discipline in accordance with Party regulations and State laws.
Do not transfer, rotate, appoint, confer or promote military ranks; confer, award or recognize Party or State titles on Party members who are being considered for disciplinary action by the Party organization.
The regulation states that party members must implement proposals on innovation and creativity according to Conclusion No. 14-KL/TW dated September 22, 2021 of the Party Central Committee.PolitburoIf the competent authority permits but damage occurs, the competent authority shall clearly determine the objective and subjective causes and make an objective and comprehensive assessment; if the policy has been properly implemented and there is a pure motive for the common good, then disciplinary action shall be exempted or responsibility shall be reduced.
It is noteworthy that Regulation 69 has disciplinary provisions for party members who violate regulations on anti-trading for positions and power.
Party members who violate one of the following cases and cause less serious consequences will be subject to disciplinary reprimand:
Approaching, establishing relationships, giving gifts to people with responsibilities, positions, powers or related people to gain favor and support for the purpose of obtaining a job position, position, or power.
Influence, bribe, or pressure a person with authority or responsibility to recommend or appoint oneself or another person to a position or office that is beneficial to the individual.
Set conditions and put pressure on those with authority and responsibility in recommending, nominating, and appointing you.
Bargaining, setting conditions, making unreasonable demands on organizations or individuals with authority and responsibility to be arranged into positions or jobs.
Interfering, influencing, or pressuring others to decide or advise, propose, comment, evaluate, vote, or recommend personnel for personal purposes.
Delay, do not perform or choose a time that is beneficial to the staff to perform the personnel work process.
In case of disciplinary action but re-offending or first-time violation causing serious consequences or violating one of the following cases, the disciplinary action shall be in the form of warning or dismissal from office (if holding a position):
Not directing the consideration and handling of recommendations from the Fatherland Front and socio-political organizations on negative behavior in personnel work or covering up and abetting this negative behavior.
Taking advantage of position and power to manipulate and cover up negative behavior in evaluating cadres, arranging and appointing cadres, and elections; making incorrect decisions to allow others to obtain positions, titles, and benefits contrary to regulations.
Interfering and influencing against regulations in personnel work; appointing and assigning unqualified personnel according to regulations. Allowing others to take advantage of their positions and powers to arrange and appoint personnel.
Lack of responsibility in handling cadres and party members who have negative behavior in arranging and appointing cadres or not recommending and considering handling according to regulations for this negative behavior.
Covering up, not handling, not resolving complaints and denunciations of party organizations and party members with negative behavior in arranging and appointing officials.
Giving or receiving gifts to people in charge or people involved in deciding on appointments, transfers, rotations, rewards, and discipline.
Party members are subject to disciplinary action by expulsion in case of violating the above regulations causing very serious consequences or giving or receiving bribes to be assigned or appointed or appointing many unqualified cadres, causing very serious consequences.../.
