New regulations on 3 types of drugs used to execute death sentences

The Government has just issued a Decree47/2013/ND-CPamending and supplementing a number of articles of Decree No.82/2011/ND-CPDecree dated September 16, 2011 of the Government on the execution of death penalty by lethal injection.

According to the Decree82/2011/ND-CP, injection drugs used for execution include: Anesthetic drugs (Sodium thiopental); drugs used to paralyze the nervous system and muscles (Pancuronium bromide); drugs used to stop the heart's activity (Potassium chloride).

The above regulation has been amended and supplemented in Decree 47/2013/ND-CP, specifically: Injectable drugs used for execution of death sentences include 3 types: Drugs that cause loss of consciousness; drugs that paralyze the motor system; drugs that stop the heart's activity.

One dose includes the three medicines listed above and is for one person.

The handover of drugs must be recorded in a delivery and receipt record; sealed and strictly managed according to the provisions of law.

The Ministry of Health is responsible for ensuring the supply of drugs for use in execution of death sentences according to the annual drug budget plan of the Ministry of Public Security and the Ministry of National Defense; providing guidance on the preservation and use of drugs used in execution of death sentences; presiding over and coordinating with the Ministry of Public Security and the Ministry of National Defense to promulgate the list and dosage of drugs used in execution of death sentences.

This Decree takes effect from June 27, 2013.
