New regulations on appointment of leadership and management positions for civil servants
For personnel expected to be mobilized and appointed as leaders and managers from outside the agency or unit by competent authorities, the agency or department advising on organization and personnel shall carry out work in three steps.
In Decision 727 recently issued by the Ministry of Home Affairs, the procedure for appointing leadership and management positions for civil servants is stipulated to first request the appointment policy.
Accordingly, agencies and units that need to appoint management officials must submit a written request for approval to the competent authority, clearly stating the positions and titles that need to be completed, the expected human resources to be appointed, and the expected assignment of specific fields and tasks.
Within 10 working days from the date of receipt of the request, the competent appointing authority must consider and decide on the appointment policy.
Within 30 working days from the date of written agreement on the appointment policy, the agency, organization or unit must complete the implementation of the personnel process according to regulations.
Appointing local staff in 5 steps, staff from other places in 3 steps
The implementation of the appointment process for on-site human resources must go through the following steps: collective leadership conference (1st time); expanded collective leadership conference; collective leadership conference (2nd time); key staff conference; collective leadership conference (3rd time).
In which, at step 5 - collective leadership conference (3rd time), before holding the conference, the agency or unit shall have a written request for the Standing Committee of the Party Committee, Party cell or Party Committee, Party cell (in places without a Standing Committee or Party cell) to evaluate and comment in writing on personnel; conduct verification and conclude on newly arising issues (if any) regarding personnel.
At the conference, the leadership discussed and voted on personnel by secret ballot. Selection principle: the person with the highest number of votes among those who achieved a rate of over 50% calculated on the total number of people summoned for recommendation will be selected for appointment. In case 2 people have the same number of votes, both achieving a rate of 50%, the leader will consider and select personnel to propose for appointment; at the same time, fully report the different opinions for the competent authority to consider and decide.
The results of the vote count are recorded in the minutes. The head of the public service unit issues an appointment decision according to his/her authority or submits it to the competent authority for consideration and decision.
In case the competent authority plans to mobilize and appoint personnel from the sourceexternal staff, unit or proposed by agency, organization or unit, the agency, department advising on organization and personnel shall carry out the work in 3 steps.
Accordingly, the first step is to discuss opinions with the leadership of the agency or unit receiving the personnel about the appointment policy.
Step 2 is to discuss the appointment policy with the leadership team of the place where the person is working. The leadership team of the place where the person is expected to be appointed organizes a vote. The person proposed for appointment must receive more than 50% of the votes of the leadership team. If the rate reaches 50%, the leader will consider and decide. If the rate reaches less than 50%, the report will be submitted to the competent authority for consideration and decision...
Step 3 is to preside over and coordinate with relevant agencies and organizations to assess personnel and prepare a report for submission to competent authorities for consideration and decision.
Requirements and conditions for implementationGeneral for personnel is to ensure general standards according to regulations of competent authorities.
In addition, personnel from local sources must be planned for appointed positions or titles or planned for equivalent or higher positions or titles.
For personnel from other sources, they must be planned for equivalent positions or titles or higher. Special cases shall be considered and decided by competent authorities. In cases where a newly established unit has not yet approved the planning, it shall be considered and decided by competent authorities.
Personnel must have held the current position or equivalent position for at least 2 years (24 months), if not consecutive, it can be accumulated (only accumulated for the time holding the equivalent position), except in the case of first appointment. Special cases will be considered and decided by the competent authority.
Aboutage of appointment, an official proposed for the first appointment to a management position or proposed for appointment to a higher management position must be old enough to serve the entire term of appointment.
Officials appointed to a new position equivalent to or lower than the current position shall not be considered for appointment age according to the above regulations.
Officials must be healthy enough to fulfill assigned tasks and responsibilities; not be prohibited from holding positions, not be under disciplinary action, not be prosecuted, investigated, prosecuted, or tried, and not be subject to disciplinary regulations according to Party and law regulations.
Officials who are disciplined during their term of office shall not be appointed or recommended for candidacy to a higher position within the time limit prescribed by the Party and the law.
