New regulations on auto warranty and maintenance services business

The Government has just issued Decree 116/2017/ND-CP stipulating the conditions for production, assembly, import and business of automobile warranty and maintenance services.

» What does the 5,000 km periodic car maintenance include?

In particular, regarding the conditions for operating an automobile warranty and maintenance facility, an enterprise established in accordance with the provisions of law is granted a Certificate of automobile warranty and maintenance facility when meeting the following 10 conditions:

1- The factory is built on land under the legal use rights of the enterprise.

2- Premises and factory ensure service for warranty and maintenance.

3- There are areas for receiving, handing over, maintenance, repair, factory inspection, operations, spare parts and accessories warehouse, and car wash area to meet the work requirements.

4- Have full range of tools and equipment for car warranty and maintenance work. Measuring equipment for car warranty and maintenance work must comply with the regulations of law on measurement.

5- Have equipment to diagnose the engine and technical condition of the vehicle (for cars equipped with electronic control units) suitable for the types of vehicles that the facility performs warranty and maintenance. The diagnostic equipment software must comply with intellectual property regulations.

6- Have a team of human resources and a quality management system to ensure the quality of car warranty and maintenance.

The above conditions of automobile warranty and maintenance facilities must meet the requirements on premises, equipment, tools, human resources, and quality management system for automobile maintenance and repair facilities according to the corresponding types of automobiles in National Standard TCVN 11794 Standards for automobile maintenance and repair facilities and similar vehicles.

7- There is a commitment to provide technical support and supply of components and accessories for automobile warranty and maintenance of: Domestic automobile manufacturing and assembling enterprises (in case of providing warranty and maintenance services for domestic automobile manufacturing and assembling enterprises); or foreign automobile manufacturing and assembling enterprises (in case of providing warranty and maintenance services for automobile importing enterprises).

8- Have sufficient human resources and plans to ensure occupational safety and hygiene according to the provisions of law on occupational safety and hygiene.

9- Meet all fire prevention and fighting safety conditions and fire fighting plans according to fire prevention and fighting laws.

10- Have complete environmental protection records approved by competent authorities in accordance with environmental protection laws.

The Vietnam Register under the Ministry of Transport (Inspection Agency) is the competent authority to issue Certificates of automobile warranty and maintenance facilities.
