Pursuant to the Law on Organization of People's Councils and People's Committees dated November 26, 2003;
Pursuant to Decision No. 09/2015/QD-TTg dated March 25, 2015 of the Prime Minister promulgating the Regulation on implementing the one-stop mechanism and the inter-connected one-stop mechanism at local state administrative agencies;
Considering the proposal of the Director of the Department of Home Affairs in Submission No. 207/TTr-SNV dated August 25, 2015,
DECISION:
Article 1. To issue, together with this Decision, the Regulations on implementing the one-stop mechanism and the interconnected one-stop mechanism at agencies and units in Nghe An province.
Article 2. The Decision takes effect 10 days after the date of signing. The regulations on the implementation of the one-stop mechanism and the inter-connected one-stop mechanism in Nghe An province that are contrary to the provisions of this Decision are annulled.
Article 3. Chief of Office of the Provincial People's Committee; Director of the Department of Home Affairs; Directors of departments, Heads of provincial-level departments and branches; Chairmen of People's Committees of districts, cities and towns; Chairmen of People's Committees of communes, wards and towns and Heads of relevant agencies and units are responsible for implementing this Decision.

Chapter I
GENERAL PROVISIONS
Article 1. Scope of regulation
This regulation stipulates the implementation of the one-stop mechanism and the interconnected one-stop mechanism at agencies and units in Nghe An province.
Article 2. Subjects of application
1. Specialized agencies under the Provincial People's Committee and the Southeast Economic Zone Management Board (hereinafter referred to as provincial departments, branches and sectors).
2. People's Committees of districts, cities and towns (hereinafter referred to as district level).
3. People's Committees of communes, wards and towns (hereinafter referred to as commune level).
4. Public service units in the health sector include: Provincial general hospitals and district general hospitals.
During the implementation process, based on the task requirements and transaction levels of agencies and units in each period, the Provincial People's Committee shall consider and decide to apply additional regulations to other public service units and state-owned enterprises.
Article 3. Scope of application of one-stop mechanism and interconnected one-stop mechanism
1. The one-stop mechanism is implemented in handling administrative procedures under the authority of one of the agencies specified in Article 2 of this regulation.
2. The one-stop mechanism is implemented in handling administrative procedures under the authority of
many administrative agencies in the following areas:
a) Field of business registration and investment;
b) Land and environment;
c) Field of construction licensing;
d) Judicial field;
d) Other fields decided by the Chairman of the Provincial People's Committee.
Article 4. One-stop mechanism, interconnected one-stop mechanism, receiving and returning result department
1. The concept of one-stop mechanism and interconnected one-stop mechanism is stipulated in Clause 1 and Clause 2, Article 1 of the Regulation on implementing one-stop mechanism and interconnected one-stop mechanism at local state administrative agencies issued together with Decision No. 09/2015/QD-TTg dated March 25, 2015 of the Prime Minister.
2. The concept of the Department of receiving and returning results is specified in Clause 1 and Clause 2, Article 2 of the Regulations on implementing the one-stop mechanism and the interconnected one-stop mechanism at local state administrative agencies issued together with Decision No. 09/2015/QD-TTg dated March 25, 2015 of the Prime Minister.
Article 5. Principles of implementing the one-stop mechanism and the interconnected one-stop mechanism
The principles for implementing the one-stop mechanism and the interconnected one-stop mechanism shall be implemented in accordance with the provisions of Article 3 of the Regulations on implementing the one-stop mechanism and the interconnected one-stop mechanism at local state administrative agencies issued together with Decision No. 09/2015/QD-TTg dated March 25, 2015 of the Prime Minister.
Chapter II
SPECIFIC PROVISIONS
Article 6. Department of receiving and returning results
1. The receiving and returning results department is established in the agencies and units specified in Article 2 of these Regulations.
Transaction name: Name of agency, unit + Department receiving and returning results according to the one-stop mechanism (interconnected one-stop mechanism).
2. Location of the Reception and Results Department.
a) The receiving and returning of results department of provincial departments and branches is located at the agency office and is under the management and direction of the office of the department and branch. For the provincial People's Committee office, it is located at the Administrative - Organizational Department and is under the comprehensive management of the Administrative - Organizational Department;
b) The reception and result return department of the district-level People's Committee is located at the Office of the People's Council and the People's Committee, under the management and direction of the Office of the People's Council and the People's Committee at the district level;
c) The receiving and returning results department of the People's Committee at the commune level is located at the headquarters of the People's Committee at the commune level;
d) The receiving and returning results department of public service units in the health sector is located at the headquarters of the service unit;
d) The modern reception and result delivery department is located in a prominent location of the state administrative agency, convenient for individuals and organizations in the process of carrying out administrative transactions.
3. Duties of the Reception and Results Department.
a) Receive organizations and individuals at the office of the Reception and Results Department when handling work under the one-stop mechanism or the interconnected one-stop mechanism;
b) Guide and receive documents from organizations and individuals for complete and correct documents, record received documents. Guide organizations and individuals to competent departments (agencies) to resolve requests that are not under their authority;
c) Transfer the organization's and individual's records to specialized departments (sections, agencies) for processing or directly handle them according to regulations;
d) Receive results from specialized departments (sections, agencies) and return them to organizations and individuals; collect fees and charges according to regulations;
d) Archive records and documents. Report results periodically monthly, quarterly and annually;
e) Research and propose to heads of agencies and units solutions to reform administrative procedures.
Article 7. Organization of the department receiving and returning results
1. Department organization
a) The receiving and returning of results department of provincial departments, branches and sectors is headed by a civil servant leading the Office. For the Provincial People's Committee Office, a civil servant leading the Administrative - Organizational Department is headed by a civil servant leading the Administrative - Organizational Department;
b) The reception and result delivery department of the district-level People's Committee is headed by a civil servant leading the Office of the People's Council and the district-level People's Committee;
c) The receiving and returning results department of the People's Committee at the commune level is directly in charge of the Chairman of the People's Committee at the commune level;
d) The department receiving and returning results of the public service unit in the health sector is assigned a department head by the superior management agency of the service unit.
2. Arrangement of civil servants and public employees
a) Civil servants working directly at the Reception and Result Return Department of provincial-level departments, branches and sectors, and district-level People's Committees are civil servants working full-time to receive dossiers and return administrative procedure results to organizations and citizens. Particularly for commune level, civil servants working at the Reception and Result Return Department are arranged to hold part-time positions according to the organizational characteristics of the Commune-level People's Committee. Officials working at the Reception and Result Return Department of public service units in the health sector are arranged by the unit to work full-time or part-time;
b) The number of civil servants working full-time at the Reception and Result Delivery Department of administrative agencies at all levels is determined in the total number of staff assigned to the agency or unit. The number of civil servants working at the Reception and Result Delivery Department of the health sector's public service units is determined in the total number of employees assigned to the agency or unit;
Article 8. Working area and equipment of the Reception and Results Department
1. Minimum working area of the Reception and Result Delivery Department.
a) Implement according to the provisions at points a, b, c, clause 1, Article 9 of the Regulations on implementing the one-stop mechanism and the inter-connected one-stop mechanism at local state administrative agencies issued together with Decision No. 09/2015/QD-TTg dated March 25, 2015 of the Prime Minister. Particularly for public service units in the health sector, the Receiving and Returning Results Department is allocated an area suitable to the specific requirements of each unit;
In the total working area of the Reception and Results Department, about 50% of the area must be reserved for waiting areas for individuals and organizations coming to conduct transactions;
b) In case the current headquarters does not meet the area requirements, the agencies must allocate a reasonable area to arrange the office of the Reception and Results Department, and a waiting area for individuals and organizations; when renovating, upgrading or building a new agency headquarters, the reception and results department must be arranged with the minimum area according to regulations.
2. Equipment of the Reception and Results Department
a) The receiving and returning results department of state agencies at the provincial and district levels must arrange the minimum equipment including: Computers and UPS, printers, scanners, photocopiers, LAN systems connected to the Internet, wifi broadcasting equipment, document cabinets, landline phones, desks and chairs, nameplates, titles, fans or air conditioners, waiting chairs, suggestion boxes, public posting boards of administrative procedures, departmental working regulations, and instructions for citizens;
b) The receiving and returning results department of state agencies at the commune level must arrange the minimum equipment including: Computer, photocopier, fax machine, printer, landline phone, document cabinet, desk and chair, nameplate, title, fan or air conditioner, waiting chair, suggestion box, public posting board of administrative procedures, working regulations of the department;
c) Encourage units to equip more electronic devices and apply information technology at the Reception and Result Delivery Department such as: Administrative procedure disclosure system, providing information on administrative procedure settlement progress, electronic one-stop software, surveillance camera system, electronic bulletin board, online feedback system... For units building a modern Reception and Result Delivery Department, the Department's equipment must meet the regulations at Point b, Clause 2, Article 9 of the Regulations on implementing the one-stop mechanism, the interconnected one-stop mechanism at local state administrative agencies issued together with Decision No. 09/2015/QD-TTg dated March 25, 2015 of the Prime Minister.
Article 9. Civil servants and public employees working at the Reception and Results Department
1. Requirements and responsibilities
Implement according to the provisions in Clause 1, Clause 2, Article 10 of the Regulation on implementing the one-stop mechanism and the inter-connected one-stop mechanism at local state administrative agencies issued together with Decision No. 09/2015/QD-TTg dated March 25, 2015 of the Prime Minister.
2. Benefits
a) Receive training in professional expertise, soft skills and cultural behavior, communication with individuals and organizations;
b) Enjoy support according to regulations.
3. Manage civil servants and public employees working at the Reception and Results Department.
a) Civil servants working at the Reception and Results Department of provincial departments, branches and sectors are under the direct and comprehensive management of the Chief of Office of the department, branch and sector. For the Provincial People's Committee Office, they are under the direct and comprehensive management of the Head of the Administration - Organization Department;
b) Civil servants working at the Reception and Results Department of the district-level People's Committee are under the direct and comprehensive management of the Chief of Office of the People's Council and the district-level People's Committee;
c) Civil servants working at the Reception and Results Department of the People's Committee at the commune level are civil servant positions according to the provisions of the Law on Cadres and Civil Servants assigned by the Chairman of the People's Committee at the commune level and under the management of the Chairman of the People's Committee at the commune level;
d) Officials working at the Reception and Results Department of the Health sector's public service units are under the comprehensive management of the assigned department.
Article 10. Working time
Civil servants and public employees of the Department receive and return work results during office hours on weekdays and Saturdays (if any) according to regulations.
Article 11. Procedures for implementing the one-stop mechanism and the interconnected one-stop mechanism
Implement according to the provisions in Article 6, Article 7 of the Regulations on implementing the one-stop mechanism and the interconnected one-stop mechanism at local state administrative agencies issued together with Decision No. 09/2015/QD-TTg dated March 25, 2015 of the Prime Minister.
Chapter III
IMPLEMENTATION ORGANIZATION
Article 12. Responsibilities of agencies and units in implementing and carrying out the one-stop mechanism and the interconnected one-stop mechanism
1. Department of Home Affairs
a) Preside over and coordinate with agencies and units to guide, urge, monitor and inspect the implementation of this Regulation at agencies and units; promptly handle any problems arising during the implementation process and report to the Provincial People's Committee;
b) Advise the Chairman of the Provincial People's Committee to decide on areas to be implemented under the one-stop mechanism at agencies and units in the province;
c) Preside and coordinate with relevant agencies to advise the Provincial People's Committee to regulate allowances and uniforms for civil servants and public employees working at the Reception and Results Department at all levels;
d) Organize training on professional expertise and administrative communication skills for civil servants and public employees working at the Reception and Results Department at all levels;
d) Advise the Provincial People's Committee to promulgate criteria for evaluating and classifying the annual implementation of the one-stop mechanism and the interconnected one-stop mechanism of agencies and units in the province.
2. Department of Planning and Investment
a) Advise the Provincial People's Committee to arrange investment capital to deploy the construction of a modern reception and result delivery unit at district-level units;
b) Preside over and coordinate with relevant agencies to advise on the implementation, urge, inspect and evaluate the results of the implementation of interconnection mechanisms in the assigned field as the presiding agency;
3. Department of Finance
a) Advise the Provincial People's Committee to arrange funding to ensure effective implementation of the one-stop mechanism and the interconnected one-stop mechanism at agencies and units;
b) Guide the collection, expenditure and use of funding sources to ensure the operation of the Reception and Results Department of agencies, units and localities.
4. Department of Justice
a) Advise the Chairman of the Provincial People's Committee to guide the implementation of administrative procedure control work, issue decisions to promulgate administrative procedures under the authority of agencies and units;
b) Preside and coordinate with relevant agencies to advise the Provincial People's Committee on implementing the one-stop mechanism in the field of Justice.
5. Department of Construction
a) Well implement the tasks of the agencies participating in implementing the one-stop mechanism according to the regulations of the Provincial People's Committee;
b) Preside and coordinate with relevant agencies to advise the Provincial People's Committee on implementing the one-stop mechanism in the field of construction licensing.
6. Department of Natural Resources and Environment
a) Well implement the tasks of the agencies participating in implementing the one-stop mechanism according to the regulations of the Provincial People's Committee;
b) Preside and coordinate with relevant agencies to advise the Provincial People's Committee on implementing the one-stop mechanism in the fields of land and environment.
7. Department of Health
Preside over and coordinate with the Department of Home Affairs and relevant agencies to guide and direct the implementation of the one-stop mechanism at public service units under the industry.
8. Department of Information and Communications
Unified management of the information technology system at the receiving and returning results department; coordinate with Nghe An Newspaper, Provincial Radio and Television Station to widely disseminate and propagate the content of this Regulation to individuals and organizations to know and monitor the implementation.
9. The Provincial Radio and Television Station, Nghe An Newspaper and mass media agencies in the province are responsible for disseminating and propagating the implementation of the contents of this Regulation.
10. Department Directors, Heads of provincial-level departments and branches, Chairmen of district-level People's Committees, Chairmen of commune-level People's Committees, Heads of public service units in the health sector implement the one-stop mechanism:
a) Arrange a sufficient number of civil servants and public employees with appropriate expertise and skills to work at the Reception and Results Department;
b) Issue regulations on the organization and operation of the Department of receiving and returning results under the one-stop mechanism and the interconnected one-stop mechanism, which stipulates the procedures for receiving and handling records under the one-stop mechanism and the interconnected one-stop mechanism at agencies and units;
c) Organize the reception, processing and return of results of file processing according to the one-stop mechanism, the interconnected one-stop mechanism in accordance with this Regulation and relevant current regulations;
d) Arrange the office of the Reception and Results Department in a convenient location with an area that meets work requirements. Equip with necessary facilities to ensure the operation of the staff of the Reception and Results Department and serve individuals and organizations when they come to transact, apply information technology to computerize work processes, increase the quantity and improve the quality and efficiency of online public administrative services according to regulations of the Provincial People's Committee;
d) Fully and regularly use forms to monitor the status of receiving, processing records and returning results to organizations and individuals. For units using one-stop software, organize, use and extract forms and tracking books through the software. Do not use two different forms at the same time for each type of form and tracking book at the agency or unit;
e) Fully, regularly and clearly publicize regulations and administrative procedures in places that are easy to access, exploit and use according to the provisions of Decree No. 63/2010/ND-CP dated June 8, 2010 of the Government; publicize standards and administrative regulations to facilitate individuals and organizations to monitor implementation. Open suggestion books and suggestion boxes; publicly post hotline numbers and email boxes of the Standing Office of the Provincial People's Committee on administrative reform (Department of Home Affairs); phone numbers and email boxes of leaders of agencies and units for organizations and individuals to conveniently contact and provide feedback;
g) Organize training courses on expertise, professional skills and communication skills with individuals and organizations in the process of handling work for civil servants and public employees working in the Reception and Results Department in the field under their management;
h) Deploy information and propaganda work widely on media and communication such as newspapers, radio, television, electronic information portals/pages and other visual forms on the implementation of the one-stop mechanism and the interconnected one-stop mechanism so that individuals and organizations know, implement and monitor the implementation;
i) Guide, urge, regularly monitor and inspect the operations of the Reception and Results Department, of civil servants and professional officials, promptly correct existing problems and limitations, and resolve problems and difficulties arising during the implementation process;
k) Fully and promptly conduct self-assessment and annual assessment and classification of the implementation of the one-stop mechanism.

Article 13. Implementation costs
The budget for implementing the one-stop mechanism and the inter-connected one-stop mechanism is arranged in the annual state budget estimate assigned by competent authorities according to the state budget decentralization and the support budget source from the provincial budget is approved by competent authorities.
Article 14. Rewards and discipline
1. The results of implementing the one-stop mechanism and the interconnected one-stop mechanism are one of the bases for assessing the level of completion of annual work tasks of heads of state administrative agencies at all levels and of cadres, civil servants and public employees.
2. Chairmen of the People's Committees at district and commune levels, heads of state administrative agencies, public service units, civil servants and public employees who have successfully completed their tasks in implementing the one-stop mechanism and the inter-connected one-stop mechanism shall be considered and rewarded annually in accordance with the provisions of the law on emulation and rewards. Civil servants and public employees with good capacity in implementing the one-stop mechanism and the inter-connected one-stop mechanism are the source of cadres in the planning, considered and appointed by the agency.
3. Agencies, organizations and individuals who violate regulations or obstruct the implementation of the one-stop mechanism or the inter-connected one-stop mechanism will be classified as failing to complete their annual work tasks and, depending on the level of violation, will be considered and handled according to the provisions of law. Agencies and units will strictly handle cases of instructing organizations and individuals to supplement documents 02 times or more, adding document components outside of regulations or processing documents and returning results to organizations and individuals late without a valid reason.
Article 15. Resolution of problems
In the process of implementing this Regulation, if any problems arise, agencies and units should promptly report to the Department of Home Affairs for synthesis and reporting to the Provincial People's Committee for consideration and decision./.
