Regulations on penalties for drivers of cars violating regulations on transporting oversized and overweight goods
Article 22 of Decree 168/2024/ND-CP stipulates penalties and deduction of driving license points for drivers of cars who violate regulations on transporting oversized and overweight goods as follows:
1. A fine of VND 2,000,000 to VND 3,000,000 shall be imposed for one of the following violations:
a) Transporting oversized and overweight goods without displaying the size of the goods as prescribed;
b) Failure to comply with the provisions of the circulation license, except for violations specified in Clause 2; Points b, c, and d, Clause 3 of this Article.
2. A fine of VND 8,000,000 to VND 10,000,000 shall be imposed for transporting oversized or overweight goods with a valid circulation license but the vehicle's overall dimensions (after loading goods onto the vehicle) exceed those specified in the circulation license.
3. A fine of VND 13,000,000 to VND 15,000,000 shall be imposed for one of the following violations:
a) Transporting oversized and overweight goods without a circulation license or with a circulation license that has expired or using a circulation license not issued by a competent authority;
b) Transporting oversized and overweight goods with a valid circulation license but the total weight (after loading onto the vehicle) exceeds the regulations in the circulation license;
c) Transporting oversized and overweight goods with a valid circulation license but not on the correct route specified in the circulation license;
d) Transporting oversized and overweight goods with a valid circulation license but transporting goods that are not the type specified in the circulation license.
4. In addition to being subject to penalties, those who commit violations specified in Clause 1, Clause 2, Clause 3 of this Article, if causing damage to bridges or roads, shall also be subject to remedial measures requiring restoration to the original state that was changed due to the administrative violation.
5. In addition to being subject to penalties, a person who commits a violation specified in Point a, Clause 3 of this Article shall have his/her expired circulation license or circulation license not issued by a competent authority revoked.
6. In addition to being subject to penalties, the driver who commits the violation will also have his/her driving license points deducted as follows:
a) Committing the act specified in Clause 1 of this Article shall result in a deduction of 02 points from the driving license;
b) Committing the acts specified in Clause 2 and Clause 3 of this Article will result in a deduction of 04 points from the driving license.
