Procedure for the National Assembly to elect the President
The National Assembly will elect the President by secret ballot and after being elected, the President will take an oath.
On October 3, the Party Central Committee reached a high consensus (100%) to introduce comrade Nguyen Phu Trong, General Secretary of the Central Committee of the Communist Party of Vietnam, to the National Assembly to elect him as President of the Socialist Republic of Vietnam at the 6th Session of the 14th National Assembly, opening next October.
According to Resolution 102/2015/QH13 on promulgating the internal regulations of the National Assembly session, the procedure for electing the President is stipulated in Article 31, specifically:
1. The Standing Committee of the National Assembly submits a list of nominees for the National Assembly to elect the President.
2. In addition to the list proposed by the Standing Committee of the National Assembly, National Assembly deputies have the right to nominate additional candidates or self-nominate for the position of President; the person nominated for candidacy has the right to withdraw from the list of candidates.
3. National Assembly deputies discuss at National Assembly delegations; the National Assembly Chairman may meet with heads of National Assembly delegations to discuss related issues.
4. The Standing Committee of the National Assembly reports to the National Assembly the results of discussions at the National Assembly delegations and explains and accepts the opinions of the National Assembly deputies; submits to the National Assembly for decision the list of candidates introduced by the National Assembly deputies or self-nominated.
5. The National Assembly discusses and votes to approve the list to elect the President.
6. The National Assembly establishes a vote counting committee.
7. The National Assembly elects the President by secret ballot.
8. The counting committee announces the results of the vote counting and voting.
9. The National Assembly discussed and voted to pass the resolution to elect the President.
10. The President takes the oath.
Regarding the election results, Clause 3, Article 27 of Resolution 102/2015/QH13 stipulates: The Ballot Counting Committee determines the voting results by secret ballot according to the following principle: "In the case of voting to elect positions in the state apparatus, the person who receives more than half of the valid votes in favor of the total number of National Assembly deputies and receives more votes in favor is elected.
In case of election of the same position, many people receive the same number of votes and more than half of the valid votes in favor compared to the total number of National Assembly deputies, the National Assembly will vote again on the election of this position among those who receive the same number of valid votes.
Among those put to a re-vote, the person with the most votes is elected; if after a re-vote many people still have the same number of votes, the older person is elected;
Documents submitted to the National Assembly for decision on personnel:
1. The dossier submitted to the National Assembly on the person nominated for positions to be elected or approved by the National Assembly includes:
a) Submission of competent authority or individual;
b) Audit report in cases prescribed by law;
c) Records of people nominated for positions to be elected or approved by the National Assembly and other documents as prescribed by the Standing Committee of the National Assembly.
2. The dossier of candidates recommended by additional National Assembly deputies or self-nominated candidates shall be prescribed by the National Assembly Standing Committee and must be sent to the National Assembly Standing Committee at least 2 days before the session to elect that position.
3. The dossier submitted to the National Assembly for dismissal, removal; termination of duties as a National Assembly delegate; approval of dismissal, removal from office includes:
a) Submission of competent authority or individual;
b) Other documents as prescribed by the Standing Committee of the National Assembly.
