(Baonghean.vn) - Although the resettlement was carried out to hand over the site for the Nghi Yen Solid Waste Treatment Complex (Nghi Yen landfill) project since 2006; however, up to now, after more than 15 years, 39 households in Hamlet 4, Nghi Yen Commune have not yet been granted a Land Use Rights Certificate (red book).

"Owe" land use fees?

Recently, 39 households in Hamlet 2, Nghi Yen Commune, in the resettlement area, implemented the project.Nghi Yen landfillPreviously, they had petitioned to be granted red books in the area they had moved to more than 15 years ago. However, after many meetings with local authorities to resolve and remove obstacles, the matter has not been resolved.

We (PV) were present to learn about the reality in Nghi Yen commune. The resettlement area of ​​39 households in Hamlet 2, Nghi Yen commune is located near the North-South railway overpass, most of the households have built houses and settled down.

Previously, in 2002, the Nghi Yen landfill construction project was approved by the Provincial People's Committee for investment and the Compensation and Site Clearance Council of this project was also established to conduct measurements, extracts and develop compensation and site clearance and resettlement plans. During this period, to ensure the project was implemented on schedule, the Provincial People's Committee directed the Nghi Loc District People's Committee and the Compensation and Site Clearance Council of the project to urgently implement the relocation and resettlement for households. Even the affected households received resettlement land in advance without having to pay (land allocation in 2007).

It was also the fact that land was allocated in advance without having to pay land use fees at that time that caused many consequences later. Specifically, in recent years, when people needed to get red books to ensure their family's rights, the local authorities did not know how to determine the land price to calculate the land use fee. Because the price of residential land compensated for resettlement in 2008 was 35,000 VND/m2; At present, the land price in Nghi Yen commune is about 500,000 VND/m2.

If calculated according to the late payment option, that is, in 2008 there was a tax payment notice, but people did not pay, then people must pay land use fees plus late payment fees (VND 35,000 + VND 73,000 late payment from September 2008 to 2021). If calculating land prices according to the current time in Nghi Yen commune, with an area ranging from 490m2up to 510m2For each household, the amount of money people have to pay is more than 200 million VND (people do not agree with this plan).

Mr. Pham Van Thanh - head of hamlet 2, Nghi Yen commune said: At the time of moving to give up land for the project, each household was compensated 17,250,000 VND/sao, when moving to the resettlement area, the land use fee was also calculated equivalently. Because the compensation price was low at that time, if paying the land fee, there would be no money to build a house, so at meetings with the district and province, people requested to be allowed to owe the land use fee. After that, only the parents' households were allowed to owe the land fee, and households with children over 18 years old or children who were married but still living with their parents were considered for resettlement land but had to pay the money in one go. In fact, the 39 households that have not been granted red books are all parents' households.

Mr. Thanh also said that currently, the people's wish is to apply the land price of 2008 and add late payment fees. If they have to pay a higher price, it will be very disadvantageous for the people.

According to Report No. 109/BC.UBND, dated October 1, 2021 of Nghi Yen Commune People's Committee on the results of inspection and verification of contents related to the above resettlement area, the reason why households have not paid land use fees is because at that time, the compensation for site clearance for households was very little, making it difficult to move to a new place of residence, so the households wished to request the authorities to consider exemption, delay in paying land fees and be allocated resettlement land in advance. Moreover, at that time, it was very necessary for the progress of project implementation, so resettlement land was allocated to households to implement the project on schedule.

Also in this report, Nghi Yen Commune People's Committee informed that at that time, Nghi Loc District Department of Natural Resources and Environment directed to prepare documents to issue red books to households but noted on the red books that they owed land use fees, but the households did not agree because they could not transact after issuing the books. By 2016, after many times the households requested to issue red books, the Commune People's Committee submitted a request to the District People's Committee and higher-level departments and offices to apply a land price of 100,000 VND/m2, but has not been resolved. By 2021, Nghi Yen Commune People's Committee still proposed to apply land price of 100,000 VND/m2.

Establish verification team

Regarding this issue, since 2021, after receiving recommendations on difficulties in granting red books to 39 households in the resettlement area, Nghi Loc District People's Committee has held many meetings to handle the issue. However, the proposals to apply the 2008 land price plus late payment fees to resolve the issue of red books to people have not been accepted.

On May 12, 2023, the Provincial People's Committee issued Notice No. 319/TB-UBND, in which, Nghi Loc District People's Committee was assigned to review all documents and procedures in the process of implementing the Nghi Yen landfill project related to 39 households and individuals who were allocated resettlement land but did not have complete documents and procedures to be granted red books. Specifically determine the reason why 39 households agreed and seriously implemented the compensation policy and relocated to the resettlement area from 2005 to 2007 but have not yet been granted red books. The Provincial People's Committee also requested Nghi Loc District People's Committee to work with the Departments of Natural Resources & Environment, Finance, Construction, Justice and relevant agencies to agree on a handling plan, report to the Provincial People's Committee in accordance with regulations.

Talking to us, Mr. Nguyen Duc Tho - Vice Chairman of Nghi Loc District People's Committee said: After receiving people's opinions, the district has organized many meetings to handle related problems. Implementing the direction of the Provincial People's Committee, the district is currently assigning the District Inspectorate to establish a verification team to review and will soon have specific conclusions on this matter.

It is known that on July 21, 2023, Nghi Loc District People's Committee issued Decision No. 2330/QD.UBND to establish a verification team to review the records and procedures for land allocation for resettlement when implementing the site clearance for the Nghi Yen landfill construction project for the above 39 households. On November 1, 2023, the verification team issued a document requesting Nghi Yen Commune People's Committee to provide all records related to compensation, site clearance and resettlement of the Nghi Yen landfill project, phase 2005-2010 currently stored in this locality.

The verification team also requested the Nghi Yen Commune People's Committee to provide accounting books and receipts (copy) related to the collection of land use fees from Mr. Dang Xuan Hung. Because, in Report No. 109/BC.UBND dated October 1, 2021 of the Nghi Yen Commune People's Committee, it was confirmed that Mr. Hung had paid 17,250,000 VND to the Commune People's Committee, but later due to a petition, the Commune People's Committee had not submitted it to the higher level.

Talking to us, Ms. Le Thi Loan - representative of the verification team said that the verification team is collecting related records and documents. After completing the collection of records, the team will have a report sent to the leaders of the District People's Committee for consideration and conclusion, and at the same time submit it to the superiors for handling. Ms. Loan also said that up to now, she has not collected any land use fee payment notices or tax notices that the authorities sent to households at that time...
