After being "punished" by the Ho Chi Minh City Tax Department for collecting and fining nearly 150 billion VND in tax, District 1 Social Insurance said it is also reviewing Nguyen Kim's books.
"Complain" to Social Insurance
Recently, Nguyen Kim employees also signed a petition to send to the HCM City Social Insurance to request clarification of the act of evading payment of social insurance premiums as prescribed.
The petition clearly states that it requests the Ho Chi Minh City Social Insurance to conduct a comprehensive inspection of Nguyen Kim Trading Joint Stock Company for acts of fraud, law evasion, or failure to declare the correct amount of insurance premiums payable.
Specifically, it is requested to clarify the following contents: Are the salaries paid to employees (salary, allowances, etc.) paid to employees during the period fully declared to pay insurance according to the provisions of Article 4 of Circular 47/2015/TT-BLDTBXH; Has the company fully paid social insurance, health insurance, and unemployment insurance for employees?
Because the workers believe that, with the inspection results of the tax authority, the amount of personal income tax evasion for employees and workers of the company is up to more than 100 billion VND, then the amount of social insurance evasion for employees may also be corresponding, which will affect the rights of the workers.

In addition, the complaint also requests criminal prosecution if Nguyen Kim evades paying social insurance.
On the afternoon of July 11, Tien Phong newspaper reporters contacted the HCM City Social Insurance to verify the information. This unit said that because Nguyen Kim is located in District 1, the District 1 Social Insurance will receive and handle the case. The HCM City Social Insurance is also waiting for the district to send a report on the incident related to Nguyen Kim.
Contacting Mr. Pham Viet Tien - Director of Social Insurance District 1, he said he had not received any petitions related to Nguyen Kim. However, he still reviewed the books of this unit. "The review of Nguyen Kim's books has nothing to do with the collection and fine of nearly 150 billion VND by the Ho Chi Minh City Tax Department. We are just proactively reviewing Nguyen Kim's original records" - Mr. Tien said.
Will stop praising
According to research, Nguyen Kim electronics is often on the list of organizations and individuals that fulfill their tax obligations well.
Specifically, in 2013, Nguyen Kim was awarded a certificate of merit by the General Department of Taxation. In 2015, Nguyen Kim continued to be awarded a certificate of merit for its good tax payment record. It is worth mentioning that both of these commendations were during the tax inspection period (2012 - 2017), leading to the collection of a "huge" amount of tax of nearly 150 billion VND.
Responding to the question of whether the tax authority will revoke the commendation decision, a representative of the Ho Chi Minh City Tax Department said that the criteria for businesses to be commended for fulfilling their tax obligations well are quite simple.

Accordingly, based on the self-declaration and payment of the enterprise, if the next year the enterprise's total tax payment increases by about 5 - 10% (depending on the year) compared to the previous year, plus some other criteria such as not being penalized by the tax authority during the year... it will be commended.
The City Tax Department also said that when violations are discovered, they will be handled at that time and not retrospectively, so the commendation will not be revoked. Particularly in the upcoming commendation of organizations and individuals who have fulfilled their tax obligations well in 2017, if Nguyen Kim is on the list, the tax authority will also stop commending them - said a representative of the City Tax Department.
Regarding Nguyen Kim's tax evasion, Mr. Bui Van Nam, Director General of the General Department of Taxation (Ministry of Finance), said that enterprises self-declare, self-calculate, self-pay and are responsible before the law. If there is a risk, information, or denunciation, we will immediately check and handle it strictly. If we discover unintentional tax evasion, we will impose a fine according to tax law, and calculate late payment fees from the date the enterprise has not paid. If we see signs of tax evasion or law violations, we will transfer the case to the investigation agency according to the law. "Regarding the Nguyen Kim case, I have requested that the file be transferred outside the General Department for the General Department to review and study," Mr. Nam informed.
