(Baonghean.vn) - This content was raised by the People's Committee of Hung Nguyen district at the press conference to inform about land recovery for the household of Ms. Nguyen Thi Huyen (residing in block 16, Hung Nguyen town) held on the morning of August 14, 2018.
Attending the press conference were representatives of the Provincial People's Committee's Reception Committee, the Department of Information and Communications; representatives of central and local press agencies. Mr. Hoang Van Phi - Secretary of the District Party Committee, Mr. Ngo Phu Han - Chairman of the Hung Nguyen District People's Committee chaired the press conference.
According to the representative of the Compensation Council for Land Acquisition and Clearance of Hung Nguyen District, related to the VSIP Nghe An Urban Industrial Park Infrastructure Construction and Business Project, in Block 16, Hung Nguyen Town, the residential land of 10 households was affected. Of which, Ms. Nguyen Thi Huyen's household and 8 other households were subject to resettlement.

Regarding the resettlement location for 9 households, initially, the People's Committee of Hung Nguyen town proposed a location along National Highway 46, in Block 8. However, the households did not agree and requested to be resettled at the sports field in Block 10. The District People's Committee held a meeting with the households and agreed with the wishes of the people.
During the process of extracting and measuring additional cadastral maps of the land to carry out compensation work for site clearance, the Provincial Land Use Registration Office has worked many times with households to carry out the measurements.
However, the households requested to measure the total area from the National Highway to the drainage ditch before coordinating to set up markers to determine the boundary for the measurement (This drainage ditch was built in October 2014 to prevent the discharge of domestic wastewater from households in block 16 into the rice fields of households in block 9).
To ensure the progress of the project, the relevant parties have agreed to measure the entire current status from the road to the ditch for the households. This clearly shows each specific area so that the Town People's Committee can confirm the origin to serve as a basis for determining compensation conditions according to the provisions of law.

After the measurement results were approved by the Department of Natural Resources and Environment, on September 20, 2016, the People's Committee of Hung Nguyen district issued a notice of land recovery for households. After that, the District Land Acquisition Council carried out the process of preparing a compensation, support, and resettlement plan and submitted it to specialized departments for appraisal before the District People's Committee issued a Decision on land recovery and a Decision approving the compensation and support plan.
During the process of preparing compensation and support documents, some households requested compensation for the increased area due to the construction of the canal. However, after being explained, the households agreed to the compensation and support plan; received compensation and handed over the land to the state.
Only Mrs. Nguyen Thi Huyen's family did not agree and filed a complaint.

Regarding the implementation of compensation and support for the case of Ms. Nguyen Thi Huyen's household, according to the People's Committee of Hung Nguyen district, Ms. Huyen and her husband (Mr. Nguyen The Duy, deceased) are the users of land plot 153, the extract of the additional measurement and drawing of the cadastral map of land plot No. 279/BĐĐC/VPĐK carried out by the Nghe An province land use rights registration office was approved by the Department of Natural Resources and Environment on September 14, 2016. The measured area is 322.1m22.
This land plot has been granted Land Use Rights Certificate No. BQ269237 dated June 3, 2014, which clearly states: land plot area 240m2Land use purpose: urban residential land 120m2, flat land for growing other annual crops (garden land) 120m2On this plot of land, there is a level 4 house and some outbuildings.
Pursuant to Article 79 of the Land Law; Article 6 of Decree 47; Article 5 of Decision 58 and current legal provisions on compensation, support and resettlement when the State acquires land,Hung Nguyen District People's Committee has prepared a dossier and approved a compensation and land support plan for her family with a total area of 240m2.2. Of which 120m2land and 120 m2garden soil
After the District People's Committee approved the compensation and support plan, Ms. Huyen did not agree and requested compensation for the entire area of 322.1m2.2measured according to current status. Of which 200m2residential land and 122.1 m2 garden land. At the same time, send a complaint to the Chairman of the District People's Committee.

On October 30, 2017, the District People's Committee issued Decision No. 911/QD-UBND on the settlement of the first complaint. It affirmed that Ms. Huyen's complaint was a false complaint and upheld Decision No. 61/QD-UBND dated August 9, 2017 on the approval of the compensation and resettlement support plan when the State reclaims land to implement the project of Construction and Business of Infrastructure of VSIP Nghe An Urban Industrial Park and Services. Disagreeing with the decision to settle the complaint of the District People's Committee, Ms. Huyen continued to submit a complaint to the Provincial People's Committee.
On February 14, 2018, the Provincial People's Committee issued Decision No. 671/QD-UBND on the settlement of Ms. Nguyen Thi Huyen's complaint (2nd time). It affirmed that Ms. Huyen's complaint was a false complaint because the People's Committee of Hung Nguyen district based on the land use right certificate to establish a land compensation plan in accordance with regulations. However, during the process of verification and inspection, the interdisciplinary working group directed the People's Committee of Hung Nguyen town to re-determine the origin and land use process. Determining the area of the land plot 240m2, used since 1992. Proposed recognition of 240m2of which 200m2land and 40m2garden land. At the same time, proceed to re-apply compensation price for property and house on land for her family according to the latest Decision of the Provincial People's Committee.
Implementing the conclusion in the Decision on handling complaints of the Provincial People's Committee, the People's Committee of Hung Nguyen district has prepared a dossier and approved the adjustment and supplement of the compensation and support plan for her family with a residential land area of 200m2.2and garden land is 40m2(Land recovery decision No. 253/QD-UBND and Decision approving the adjustment and supplement of plan No. 254/QD-UBND dated March 19, 2018).

For area 82.1m2 increased compared to the land use right certificate, Hung Nguyen town People's Committee confirmed the increase after implementing the policy of building a drainage ditch for domestic wastewater of people in block 16 to agricultural land of block 9 in October 2014. At the time of preparing the land acquisition dossier, this area was actually a barren water surface.
Therefore, the District People's Committee has no basis to prepare compensation and support records for this area.This content has also been concluded by the People's Committee of Nghe An province as a false complaint in Decision 671/QD-UBND dated February 14, 2018.
The total amount of compensation and support for Ms. Huyen approved in the 2 Decisions is: 2,964,503,678 VND. Ms. Huyen was assigned a resettlement land plot with an area of 193.2 m2After deducting land use fees at the resettlement site, Ms. Huyen received the amount of 839,303,678 VND.
Also at the press conference, the People's Committee of Hung Nguyen district informed that in the past time, the District Land Acquisition Council has coordinated with the People's Committee and the Fatherland Front Committee of the town to spend a lot of time persuading her family to comply with the policy of receiving compensation and handing over the land to the state. However, Ms. Huyen still did not agree and had some recommendations such as being compensated for 82.1m2Land increased compared to the land use right certificate; request to be assigned an additional plot of land in the resettlement area; request to be allowed to be included in the teacher's payroll...
However, these are recommendations that the People's Committee of Hung Nguyen district has no basis to resolve. Recently, Ms. Nguyen Thi Huyen has filed a lawsuit with the Provincial Court.

Also according to the People's Committee of Hung Nguyen district, on May 7, 2018, the People's Committee of the district issued Decision 451/QD-UBND on compulsory land recovery and Decision 452/QD-UBND on the establishment of the Board for compulsory land recovery for Ms. Nguyen Thi Huyen's household. After its establishment, the Board for compulsory land recovery coordinated with the People's Committee and the unions of Hung Nguyen town to continue to mobilize her family to comply with the Decision on compulsory land recovery. However, Ms. Huyen still did not agree.
Therefore, on August 11, 2018, the Land Acquisition Enforcement Board issued Notice No. 181/TB-BTHCC announcing the time for land acquisition enforcement to implement the project of Construction and Business of Infrastructure of VSIP Nghe An Urban Industrial Park and Services.
Enforcement will take place on August 15, 2018.
At the press conference, a number of journalists and reporters had their opinions exchanged. Among them, they requested clarification of information about the lack of transparency in the compensation and support provided to some families in Block 16 who were subject to resettlement; and raised the question of whether Hung Nguyen District would temporarily stop the enforcement or not because Ms. Nguyen Thi Huyen has an urgent petition sent to the Court requesting the Court to use emergency measures to request Hung Nguyen District to stop the enforcement and maintain the status quo of the housing project on her land...
Responding to the compensation for households subject to resettlement in block 16, Mr. Nguyen Huu Ha - Head of the Department of Natural Resources and Environment, Vice Chairman of the Compensation Council for Land Acquisition and Resettlement in Hung Nguyen district, stated the basis for compensation, thereby affirming that the Compensation Council for Land Acquisition and Resettlement in the district has complied with the provisions of the law. Mr. Ha further informed that at many dialogues organized by the province and Hung Nguyen district, Ms. Nguyen Thi Huyen also expressed her opinion that there was a lack of transparency in compensation and support for some families subject to resettlement in block 16, which was then thoroughly explained. Mr. Ha suggested: "If any press agency is still interested in this content, please register to work with relevant units and departments of the district to be provided with more information...".

Regarding Ms. Huyen's urgent petition to the Court requesting the Court to give its opinion to the district to stop the enforcement and maintain the status quo of the construction on the enforced land, according to Mr. Ngo Phu Han, the enforcement of land recovery for Ms. Nguyen Thi Huyen's household was carried out by the People's Committee of Hung Nguyen district in accordance with the provisions of the law, in addition, there was consultation with competent authorities. Up to now, the People's Committee of Hung Nguyen district has not received any documents from the Court related to the content of Ms. Huyen's new petition. Therefore, the People's Committee of Hung Nguyen district will enforce land recovery for Ms. Nguyen Thi Huyen's household on time as announced.
