(Baonghean.vn) - According to Circular 33/2017/TT-BTNMT effective from December 5, 2017, the land use right certificate (red book) will record the names of family members using the land together.

That is one of the solutions to eliminate fraud in the transfer of land use rights. And eliminate the situation where the transferee of land use rights is "complicated" due to the lack of consent and approval of household members other than the head of household.

From December 5, 2017, family members are listed in the red book.

Specifically, the addition of information on household members on the Certificate of land use rights and house ownership rights of Circular No. 23/2014/TT-BTNMT dated May 19, 2014 regulating the Certificate of land use rights, house ownership rights and other assets attached to land. Amend and supplement Point c Clause 1 Article 5 as follows:

“For households using land, write “Household, including Mr.” (or “Household, including Mrs.”), then write the full name, year of birth, name and identification number of the head of the household as prescribed in Point a of this Clause; permanent address of the household. In case the head of the household does not have the right to use the common land of the household, write the representative who is another member of the household who has the right to use the common land of the household.

The next line states “Jointly using land, jointly owning property attached to land (or Jointly using land or Jointly owning property) with … (write in turn the full name, year of birth, name and identity document number of the remaining members of the household sharing the right to use land, ownership of property attached to land).”

In addition, Circular 33/2017/TT-BTNMT also amends, supplements and guides a number of provisions on apartment floor area that must comply with housing law; guides the registration dossier for changes in cases where individuals transfer land use rights to enterprises; guides the use of land in cases of company conversion, conversion of private enterprises into limited liability companies...
