From today, Decree 142/2017/ND-CP on administrative sanctions for violations in the maritime sector takes effect.

Exploitation of vessels beyond their service life

- Fine of 45-55 million VND for vehicles carrying dangerous goods, oil, liquefied gas, and hovercraft.

- A fine of 55-65 million VND will be imposed on passenger transport vehicles with a capacity of more than 12 people that are not overnight tourist accommodation ships, floating hotels, floating restaurants, or hovercraft.

- Fines of 65-75 million VND for restaurants, floating hotels, and overnight tourist accommodation facilities.

In addition, organizations and individuals who violate the law will have their captain's license or captain's certificate of professional competence revoked for a period of two to three months.

Vessel registration

- Fine of 5-10 million VND for the following acts: Registering a vessel not on time; Missing one of the vessel's certificates or documents or one of the certificates or documents has expired.

- Fines from 10 to 20 million VND for the following acts: Operating a vessel without a vessel registration certificate; Not registering a change of vessel owner as prescribed; Not deleting the vessel registration.

- Fine from 20-30 million VND for the following acts: Buying, selling, renting, leasing, borrowing, lending one of the certificates of a vessel; Using one of the certificates of another vessel, a certificate with erased or altered content, or a fake certificate.

Maritime safety and order in port operations

- Warning penalty for entering or leaving port area or boarding a vessel without following instructions of competent authority or person.

- A fine of 500,000 to 1,000,000 VND shall be imposed for entering or leaving the port area or boarding a vessel without permission from the competent authority or person.

- Fines of 1-3 million VND for acts such as: Violating regulations on warning signs for ships to safely dock as prescribed; Not arranging for people to tie or untie ships; Not informing the Maritime Port Authority of the plan to dispatch ships entering and leaving the port.

- Fines of 3-5 million VND for the following acts: Using workers without licenses or practice certificates; Not promptly notifying the Maritime Port Authority of incidents and accidents related to maritime safety; Not providing the Maritime Port Authority with periodic data on the depth of the water area in front of the wharf...

- A fine of 5-10 million VND shall be imposed for intentionally declaring false information in the application for announcement of opening a seaport, offshore oil and gas port, bridge, or harbor.

- A fine of 10-20 million VND shall be imposed for intentionally using erased, altered, or forged documents in the application for announcement of opening a seaport, offshore oil and gas port, wharf, or harbor.

- A fine of 30-50 million VND shall be imposed for acts of arbitrarily naming or renaming seaports, offshore oil and gas ports, ports, wharves, buoy terminals, water areas, water regions or using or transacting with names of seaports, offshore oil and gas ports, ports, wharves, buoy terminals, water areas, water regions that are not consistent with the names announced by competent authorities.
