After three years of implementing Decision 37/2011 of the Provincial People's Committee on the Regulations for Auctioning Assets, several shortcomings and inconsistencies have emerged. Simultaneously, the Law on Handling Administrative Violations and the newly passed Land Law have created inconsistencies with the regulations in the Asset Auction Regulations within the province. To align with the development of the current legal system and local implementation practices, representatives from the Department of Justice proposed amending, supplementing, repealing, or replacing eight articles related to the organization of auctions, the rights and obligations of participants, cases of auctioning land use rights and cases not requiring auctioning land use rights, and public notification and posting of information when organizing land auctions. Representatives from several departments, agencies, and localities also contributed numerous opinions to improve Decision 37/2011.
Concluding the meeting, Comrade Thai Van Hang stated that Decision 37/2011, along with the regulations on asset auctions, will continue to be maintained. In the coming period, departments, agencies, and localities need to study and contribute opinions to finalize Decision 37/2011. The Department of Justice is responsible for compiling and finalizing the regulations on asset auctions so that the Provincial People's Committee can adjust and issue them immediately after the 2013 Land Law comes into effect.
