Amending regulations to control officials and investors going abroad

The Government Office has just issued a document conveying the opinions of Deputy Prime Minister Le Minh Khai on the implementation of recommendations after supervising the recovery of lost and misappropriated assets in criminal cases of corruption and economics.

Accordingly, the Deputy Prime Minister requested Ministers, Heads of ministerial-level agencies, Heads of Government agencies, and Chairmen of People's Committees of provinces and cities to study and implement the recommendations of the Standing Committee of the Central Committee of the Vietnam Fatherland Front.

At the same time, take measures to overcome shortcomings and deficiencies in the recovery of lost and misappropriated assets in criminal cases of corruption and economics. Report and propose solutions to issues beyond authority.

The Deputy Prime Minister also requested the Ministry of Justice to monitor, urge and report to the Prime Minister the results of the implementation of these recommendations.

Proposal to recover assets abroad from crimes

Previously, on March 23, the Standing Committee of the Central Committee of the Vietnam Fatherland Front made a series of recommendations after supervising the recovery of lost and misappropriated assets in criminal cases of corruption and economics.

In particular, the Standing Committee of the Central Committee of the Vietnam Fatherland Front recommended that the Government should strengthen close direction of ministries, central agencies, and People's Committees at all levels to perform their tasks and coordinate with judicial agencies in resolving and recovering assets in criminal cases of corruption and economic crimes to remove obstacles and difficulties in the implementation process.

At the same time, continue to review legal documents to propose amendments and supplements to regulations, promptly removing practical difficulties.

From there, clearly define the authority, responsibility, order and procedures of agencies, organizations and units in implementing and coordinating related activities such as connecting, exchanging information, sharing databases between agencies in the work of resolving and recovering lost and misappropriated assets in criminal cases of corruption and economics.

The Government directs the implementation of early and remote preventive measures to reduce damage and loss of corrupt assets through asset declaration of officials, civil servants, and people with positions of authority in the State apparatus; and recovery of assets abroad acquired through crimes.

In addition, consider researching the mechanism for filing a lawsuit against individuals and organizations that cause loss or damage to State property to request compensation for damages.

In addition, the Vietnam Fatherland Front also requested the Government to amend and supplement legal regulations on investment and anti-corruption in the direction of controlling overseas investment, especially overseas real estate investment. Overseas investment control needs to be implemented for people with positions, powers and their relatives.

Along with that is expanding judicial assistance between Vietnam and other countries to support the investigation, trial and execution of sentences for corruption and economic crimes in particular and all crimes in general.

Early submission of project to recover corrupt assets without going through conviction procedure

The Standing Committee of the Central Committee of the Vietnam Fatherland Front also requested the Government to strengthen the implementation of inter-sectoral inspection, examination and supervision activities on the implementation of judicial activities of investigation agencies and enforcement agencies in general and the settlement and recovery of assets in criminal cases of corruption and economic crimes in particular.

The Government directed the Government Inspectorate to strengthen inspection activities to prevent and combat corruption and negativity; promptly issue documents with specific instructions for subjects to declare assets according to regulations.

The Standing Committee of the Central Committee of the Vietnam Fatherland Front also proposed to amend and supplement the regulations on public disclosure of asset and income declarations at the declarant's place of residence for people to monitor; regulate the agency controlling assets and income in the direction of decentralization of management according to the State administrative level, identify the competent authority to conduct annual asset and income verification to improve management capacity at each level and achieve high efficiency in corruption prevention and control.

The Ministry of Public Security directs Investigation Agencies at all levels to ensure that the investigation process is carried out in parallel with the verification of lost and misappropriated State assets in order to promptly apply measures to prevent the dissipation of assets in criminal cases of corruption and economic crimes; proactively coordinate and guide difficult and problematic work activities.

In addition, the Standing Committee of the Central Committee of the Vietnam Fatherland Front also requested the Government to direct the Ministry of Justice to inspect the enforcement of civil judgments at all levels and the activities of the Steering Committees for Enforcement of Civil Judgments at all levels; to strengthen and speed up the handling of asset recovery in criminal cases of corruption and economic crimes.

Along with that, proactively coordinate with relevant agencies to provide unified guidance on difficult and problematic work activities; promptly complete and submit to competent authorities the project to recover corrupt assets without going through conviction procedures.
