Strengthening the direction of debt collection of social insurance, health insurance, unemployment insurance

(Baonghean) - Nghe An Provincial People's Committee has just issued Official Dispatch No. 8275/UBND-VX dated November 1, 2016 on strengthening the direction of debt collection of Social Insurance, Health Insurance, and Unemployment Insurance.

According to the report of Nghe An Social Insurance, as of September 30, 2016, the amount of social insurance, health insurance, and unemployment insurance debt at employers is at a high level, accounting for 3.51% compared to the calculation in 2016. Although the amount of social insurance debt has decreased compared to the same period in 2015, the debt situation is quite common and increasingly complicated, seriously affecting the rights of participants.

To immediately remedy the above situation, the Provincial People's Committee requests Directors of provincial-level Departments, branches and sectors; Chairmen of People's Committees of districts, cities and towns; Heads of agencies, units and enterprises to urgently implement the following contents:

1. For employers:

- Strictly comply with current laws on social insurance, health insurance, and unemployment insurance; be responsible for self-declaring and fully and promptly paying social insurance, health insurance, and unemployment insurance for employees.

- For employers who still owe social insurance, health insurance, and unemployment insurance, they are required to immediately pay social insurance and put an end to the long-standing debt situation.

2. Department of Finance:

- Balance the provincial budget, allocate funds for salary reform to sectors and district-level units to pay salaries and additional salary amounts according to Decree No. 47/2016/ND-CP of the Government.

- Balance the budget, promptly advise the Provincial People's Committee to provide additional funding to buy health insurance cards for subjects guaranteed by the State Budget.

- Direct the Finance and Planning Departments of districts, cities and towns to transfer money to buy health insurance cards for subjects guaranteed by the state budget in a timely and correct manner to the Social Insurance agency.

3. Department of Labor, War Invalids and Social Affairs:

- Fully and promptly allocate central budget funds authorized to districts, cities and towns to purchase health insurance cards for beneficiaries of preferential treatment for people with meritorious services and their relatives according to the provisions of the Ordinance on people with meritorious services to the revolution in 2016.

- Focus on directing the Department of Labor, War Invalids and Social Affairs of districts, cities and towns to urgently review and verify the data on health insurance card issuance for subjects whose health insurance card purchase costs are guaranteed by the state budget. By December 31, 2016 at the latest, complete the payment and transfer of health insurance card purchase costs to the health insurance fund.

- Establish an interdisciplinary inspection team of the Department of Labor, War Invalids and Social Affairs and the Social Insurance of Nghe An province in November 2016 to inspect and collect social insurance, health insurance and unemployment insurance debts for enterprises with long-term social insurance, health insurance and unemployment insurance arrears. Resolutely handle enterprises that deliberately delay or delay paying social insurance, health insurance and unemployment insurance for a long time, directly affecting the rights of employees.

Strive to achieve the target of 75% of the population participating in health insurance this year.

4. Social Insurance of Nghe An province:

- Preside and coordinate with relevant departments, branches, People's Committees at all levels, press and television agencies to focus on disseminating, supporting and providing legal advice on social insurance, health insurance and unemployment insurance policies; implement solutions to rapidly increase the coverage of social insurance, health insurance and unemployment insurance participants in the spirit of Resolution 21-NQ/TW dated November 22, 2016 of the Politburo on strengthening the Party's leadership over social insurance and health insurance work in the period 2012 - 2020, Decision No. 1167/QD-TTg dated June 28, 2016 of the Provincial People's Committee on adjusting the assignment of health insurance coverage targets for the period 2016 - 2020 in Plan No. 81/KH-UBND.VX dated February 4, 2016 of the Nghe An Provincial People's Committee.

- Focus and resolutely urge the collection of social insurance, health insurance and unemployment insurance debts at organizations, agencies and enterprises. Proactively coordinate with relevant departments and sectors to establish interdisciplinary inspection teams for social insurance and health insurance debt collection.

- Directing Social Insurance of districts, cities and towns:

- + Monthly, report on the collection of social insurance, health insurance and unemployment insurance debts of units in the area, and at the same time advise the Chairman of the People's Committee of the districts to strengthen the direction of collection and debt collection of social insurance, health insurance and unemployment insurance.

- + Coordinate with the Department of Labor, War Invalids and Social Affairs, the Department of Finance - Planning at the district level to prepare documents, unify data for settlement requests and transfer funds to buy health insurance cards for subjects guaranteed by the state budget in a timely manner according to regulations.

5. Provincial People's Court:

Trial and direct the People's Courts of districts to promptly try units violating the laws on social insurance, health insurance, and unemployment insurance when the Provincial Federation of Labor files a lawsuit.

6. Department of Planning and Investment:

Preside over and coordinate with Nghe An Provincial Social Insurance in supporting enterprises to register for social insurance for the first time, supporting enterprises to prepare documents for granting business registration certificates or decisions to establish enterprises, implementing according to the Action Program issued with Decision No. 3171/QD-UBND dated July 1, 2016 of Nghe An Provincial People's Committee.

7. Provincial Federation of Labor:

- Coordinate with Nghe An Provincial Social Insurance to propagate, inspect and supervise the implementation of social insurance and health insurance policies and regimes, and protect the rights of employees.

- Coordinate with the provincial Social Insurance in supporting trade union organizations in terms of data, procedures for filing lawsuits as well as lawsuit and judgment enforcement processes for the purpose of recovering social insurance, health insurance and unemployment insurance debts to promptly resolve the legitimate rights of employees.

8. People's Committees of districts, cities and towns:

- Direct the Department of Labor, War Invalids and Social Affairs, Social Insurance of districts and related sectors to establish inspection teams to collect social insurance, health insurance and unemployment insurance debts for enterprises with long-term social insurance, health insurance and unemployment insurance arrears in the area in December 2016. Resolutely handle enterprises that deliberately delay or delay paying social insurance, health insurance and unemployment insurance for a long time, directly affecting the rights of employees.

- Direct the Department of Labor, War Invalids and Social Affairs, the Department of Finance and Planning to coordinate with the Social Insurance at the same level to complete the procedures and documents to fully and promptly provide funds to purchase health insurance cards in 2016 to the Social Insurance agency before December 31, 2016.
