Increase fines up to 7 times, revoke licenses if counterfeiting fertilizers
More than 14,000 fertilizer products are in circulation, along with many violations. Authorities said they will increase the maximum fine by 7 times, and if necessary, revoke the license of the violating facility.
The information was given at the Seminar "Strengthening Fertilizer Market Management" organized by the Government Electronic Information Portal on the morning of October 20.
Mr. Hoang Trung, Director of the Plant Protection Department (Ministry of Agriculture and Rural Development), said that Decree 108 on fertilizer management has just been issued with many new points to tighten management of all stages of fertilizer trading, circulation and use.

If the previous testing activities were carried out by enterprises themselves, the new Decree requires that almost all types of fertilizers must be tested.
However, Mr. Trung said that with more than 14,000 types of fertilizers currently circulating on the market, testing will not be required, but will only be mandatory for new products.
A representative of the Ministry of Agriculture and Rural Development said that the agency is currently drafting a Decree on administrative sanctions in the fertilizer sector.
Basically, the contents are inherited from the old regulations, but the penalties and acts are increased by 7 times, the maximum penalty is applied, and the certificates are revoked and revoked.
In case of non-compliance, the rights will be permanently revoked or the business will be required to close.
Fake, poor quality fertilizers, imported fertilizers that do not meet requirements must be destroyed or re-exported, not recycled...

Mr. Nguyen Hac Thuy, Chairman of the Vietnam Fertilizer Association, suggested that it is necessary to thoroughly handle previous violations related to this field to ensure sufficient deterrence and not create a bad precedent for fertilizer management in the future.
"Decree 108 is an important tool but not a magic wand because if interest groups, agencies and production units still commit fraud, no decree can deal with it" - Mr. Thuy stated his opinion.
Furthermore, the incident involving 11 fertilizer testing centers was found to have committed violations in issuing fake certificates, but no one was held responsible for that.
Therefore, Mr. Thuy suggested that it is necessary to clarify and thoroughly handle related cases to create a premise for Decree 108 to ensure strictness in implementation when it comes into effect.
The amount of fertilizer licensed is 3 times the demand. The number of inorganic fertilizer products received from the Ministry of Industry and Trade for management is 13,243 products, of which from January 1, 2017 to present, it has increased by 7,840 products. The number of fertilizer production facilities received for management is 554 production facilities. Thus, the number of products in circulation is more than 14,000 products, and 706 factories, of which organic products only account for 5.3%, not to mention the amount of fertilizers that the Department of Industry and Trade continues to declare as conforming to regulations and is still being sent back. Production capacity for inorganic fertilizer is 26.5 million tons, organic fertilizer is 2.5 million tons and import is 4 million tons. Thus, the total amount of fertilizer on the market is 33 million tons, more than 3 times higher than the demand (only 10 - 11 million tons). Large surplus of fertilizers causes widespread fake and poor quality fertilizers and makes it difficult for people to recognize and choose products during the production process. |
