Pilot project to send seasonal workers to Korea

Provincial leaders are allowed to decide and sign agreements to send workers to work seasonally in Korea under the form of cooperation between localities.

The Ministry of Labor, War Invalids and Social Affairs has just sent an Official Dispatch to the People's Committees of provinces and cities, guiding the pilot project of sending seasonal workers to Korea under the form of cooperation between localities of the two countries.

Accordingly, leaders of provincial and centrally-run city agencies are allowed to decide and sign agreements on sending workers to work seasonally in Korea (with Korean partners) after obtaining written opinions from the Ministries of Foreign Affairs, Justice, Finance and Labor, War Invalids and Social Affairs.

The decision and signing of this agreement by the provincial authority's leaders is in accordance with the Government's Resolution on the pilot project of sending seasonal workers to Korea in the form of cooperation between localities of the two countries for a period of 2 years.

According to the instructions, after signing the agreement, the provincial agency is responsible for reporting to the Prime Minister in writing and sending the Ministry of Foreign Affairs a copy of the signed agreement.

Based on the scope of implementation, the provincial agency may assign the district agency or local public service organization to carry out the dispatch of workers according to the agreement (the assigned agency must clearly state in the agreement).

The subjects of the agreement are workers living in the locality that signed the agreement with the locality of Korea, with permanent or temporary residence for 12 months or more. Deputy Minister of Labor, War Invalids and Social Affairs Doan Mau Diep said: “Currently, the Korean side has a need for seasonal workers and some localities have exchanged and cooperated with the locality. For example, Da Nang and Dong Thap are currently cooperating with you. The Ministry does not stipulate which locality can participate in the program, the problem is that between localities, they have a need for cooperation, they negotiate with each other and then report to competent agencies such as the Ministry of Foreign Affairs, Labor, War Invalids and Social Affairs and the Ministry of Justice to have support and protection of citizens when necessary. Workers under the seasonal program mainly work in the agricultural sector. The working period is usually 3 months”.

The Ministry of Labor, War Invalids and Social Affairs also emphasized that when signing the agreement, localities need to pay attention to the conditions for supplying and receiving workers, including: Number of workers to be sent/received, selection criteria, industry, occupation, work to be done; workplace, working term; working conditions, working environment, working hours, rest hours, safety and labor protection; wages and overtime pay; conditions for eating, living, and living; insurance, medical examination and treatment; responsibility for paying transportation costs from Vietnam to the workplace and vice versa; conditions for early termination of the labor contract, responsibility for compensation for damages and costs of bringing workers back to the country and other related conditions.

In addition, the agreement must specifically stipulate the rights and obligations of the signatory parties in organizing the selection, training in necessary knowledge, supplementing skills and training in Korean for workers before departure./.
