Young woman gives birth to an unwanted child after being sexually abused by her 40-year-old cousin

On November 16, the People's Court of Vinh Phuc province brought defendant Hoang Minh Tien (born 1962, in Phuc Yen, Vinh Phuc) to trial for the crime of Child Rape. Sadly, Tien's victim was his niece.

Having a wife and two children, Tien and his nephew N. (born in 2002) often went to herd buffalo together every day. While herding buffalo, Tien often asked the boy to pluck gray hair and promised to pay him. After such times, Tien had the intention of having sex with N.

The defendant was taken to detention.

On March 17, 2016, Tien and N. herded buffaloes in the field again. That afternoon, Tien told his cousin: "Come to my house tonight to pay for the haircut." Since Tien was his cousin, N. trusted him and agreed.

That same evening, N. walked alone to Tien's house. When he arrived, Tien grabbed N.'s hand and dragged her into the house where he sexually assaulted her. N. struggled, pushed him away, and tried to call for help, but Tien threatened: "I forbid you to call."

Frightened, N. did not dare to scream or resist, leaving Tien to commit his depraved act. After raping N., Tien gave her 20,000 VND and threatened: "Don't tell anyone, or you'll die."

Because of Tien's threats, N. did not dare tell anyone. After that, every two weeks, Tien asked N. to come to his house so he could have sex with her. After each time, Tien threatened her: "If you tell, I will kill the whole family and throw the bodies in the ditch."

Due to difficult family circumstances, N.'s father is paralyzed in both legs. N. was afraid that Tien would harm the whole family, so she reluctantly let Tien have sex with her without daring to tell anyone.

It was not until September 2016 that Tien stopped having sexual intercourse with N. because she was entering her final year of high school and had to attend evening classes.

From March to September 2016, Tien raped his niece about 10 times.

On September 29, 2016, N.'s mother noticed many changes in her daughter's body, so she took her to the hospital and found out that N. was 35 weeks pregnant. On February 5, 2017, N. gave birth to a baby boy and later filed a complaint with the police.

Upon receiving the complaint, the investigation agency stepped in and decided to request a sexual examination of N. The results showed that N. conceived between April and May 2016. DNA testing of N.'s child showed that Tien was the child's father.

As for Tien, during the investigation, he honestly confessed all his crimes.

Regarding civil liability, N.'s father filed a petition requesting Hoang Minh Tien to pay civil compensation to N. and her family in the amount of 567 million VND, which includes the allowance for raising the child born to N.

The prosecution agency said that on March 17, 2016, Tien raped N., who was then 13 years and 8 days old. After that, Tien continued to rape N. many times. Tien's actions constituted the crime of Rape of a child with the aggravating circumstance of committing the crime multiple times, so the defendant must be severely punished.

After consideration, the panel sentenced the defendant to 14 years in prison.
