"Stealing" 5 mobile phones, sentenced to 7 months in prison
(Baonghean.vn) - Seeing a group of carpentry workers leaving their phones exposed, Toan and his friend decided to steal them and bring them to the city to sell for money.
On the morning of March 27, Thai Hoa Town People's Court tried the criminal case against Vu Dang Toan, born in 1991, residing in Block 3, Long Son Ward, for the crime of "Theft of property".
According to the testimony in court, at about 1:30 a.m. on June 17, 2016, Vu Dang Toan (born in 1991, residing in block 3, Long Son ward) and Nguyen Thanh Tung (born in 1989, residing in block Tay Ho 1, Quang Tien ward) Thai Hoa town invited each other to watch football. When passing by the carpentry workshop of Ms. Nguyen Thi Huong's family residing in block Tay Ho 1, Quang Tien ward, Toan and Tung discovered that the door of the carpentry workers' boarding house was unlocked, so they had the intention of stealing property.
After reaching an agreement, the two went down to the sugarcane garden near the carpentry workshop and climbed over the wall to enter the boarding house. Vu Dang Toan stood outside to keep watch while Nguyen Thanh Tung entered the boarding house to steal 2 cell phones from Hoang Xuan Tuan; 2 cell phones from Hoang Minh Quang and 1 cell phone from Nguyen Dinh Phuc.

After taking the above assets, Tung and Toan brought them back to Tung's house and hid them until around 4:00 a.m. on June 17, 2016, and both took a bus to Vinh City to sell the stolen assets. Tung and Toan sold three mobile phones, including 2 SONY C3s and 1 SONY M4Aqua, to Mr. Ho Tuan Long, owner of Long Ha mobile phone store at 2 Le Loi Street, Hung Binh Ward (Vinh City), for 3,800,000 VND. After selling the above assets, Nguyen Thanh Tung took 2,000,000 VND and 1 black Xphone to use, Vu Dang Toan took 1,800,000 VND and 1 white Massel 1235 to use.
On June 7, 2016, realizing that his actions were illegal, Nguyen Thanh Tung went to the Criminal Investigation Agency (Thai Hoa Town Police) to surrender and confessed to all of his acts of theft. Vu Dang Toan fled the area after committing the crime. On January 12, 2018, the Criminal Investigation Agency (Thai Hoa Town Police) arrested and wanted Vu Dang Toan according to the law.
According to the valuation report, the total value of the 5 cell phones that Toan and Tung stole from the victims was 10,500,000 VND, sufficient grounds to conclude that defendant Vu Dang Toan committed the crime of "theft of property", stipulated in Clause 1, Article 138, Penal Code.
Previously, Toan was sentenced by the People's Committee of Nghia Dan district to 24 months in a reformatory facility for theft on September 14, 2004. Vu Dang Toan completed his sentence on May 1, 2006 and on November 30, 2007, Toan was sentenced by the People's Court of Nghia Dan district to 6 months in prison for "Theft of property".
At this trial, considering that the criminal act of defendant Vu Dang Toan is a case of multiple crimes, therefore subject to aggravating circumstances as stipulated in Point g, Clause 1, Article 48, Penal Code, the Trial Panel sentenced Toan to 7 months in prison.
