Revoke "red cover" issued in violation of regulations
(Baonghean.vn) - Recently, the People's Committee of Anh Son district issued an inspection conclusion and decided to revoke a Land Use Rights Certificate (known as a red book by the people) that was issued incorrectly 20 years ago. This incident is related to the article: "A woman has been suing for land for 21 years" posted on Baonghean.vn on February 8, 2018.
The revocation of the Land Use Right Certificate issued in violation of regulations 20 years ago is stated in Inspection Conclusion No. 15/KL-UBND dated November 6, 2018 of Anh Son District People's Committee.
Accordingly, on June 28, 2018, Anh Son District People's Committee issued Decision No. 2201/QD-UBND to inspect the issuance of Land Use Rights Certificate serial number I.504125, certificate issuance number 1115.QSDD dated July 1, 1998 issued to Ms. Nguyen Thi Lu's household in Hamlet 10, Hoa Son Commune.

Through inspection and verification, it was determined that at the time of granting the land use right certificate in 1998, during the process of declaring and requesting the granting of the land use right certificate, Ms. Lu's family had declared incorrectly about the purpose and current status of land use. Specifically, in reality, plot 663, map sheet 8 had a house belonging to Ms. Nguyen Thi Lu's family, but the family declared it as garden land; plot 662, map sheet 8 did not have a house belonging to Ms. Nguyen Thi Lu's family, but only had a house belonging to Ms. Than on it (Ms. Le Thi Than - mother of Ms. Ngo Thi Huong, who had been suing for land for 21 years as reported by Nghe An Newspaper), but the family declared it as 300m2 of residential land and 756m2 of garden land belonging to the family.

After Ms. Nguyen Thi Lu's family applied for land use rights registration, the People's Committee of Hoi Son commune (old) did not check and review the land use registration with the current land use status, but confirmed the land use rights registration application of Ms. Lu's family to request the People's Committee of Anh Son district to issue a land use rights certificate to Ms. Lu's family.
Therefore, the Chairman of the People's Committee of Anh Son district concluded: The issuance of the land use right certificate with serial number: I.504125, certificate issuance number 1115.QSDD dated July 1, 1998 by the People's Committee of Anh Son district to the household of Ms. Nguyen Thi Lu, hamlet 10, Hoa Son commune (former Hoi Son commune) is not in accordance with the provisions of point d, clause 2, Article 106, Land Law 2013.

To handle the issuance of land use right certificates that are not in accordance with regulations, the Chairman of the People's Committee of Anh Son district assigned the Department of Natural Resources and Environment to advise the People's Committee of the district to revoke the Land Use Right Certificate with serial number: I.504125, certificate issuance number 1115.QSDD dated July 1, 1998 issued by the People's Committee of Anh Son district to the household of Ms. Nguyen Thi Lu, hamlet 10, Hoa Son commune in accordance with the provisions of law.
The Department of Natural Resources and Environment coordinated with the Land Use Rights Registration Office and the People's Committee of Hoa Son Commune to guide Ms. Nguyen Thi Lu's household to complete the procedures for declaring and registering to prepare a file for granting a land use rights certificate according to current regulations.
As mentioned above, the fact that the People's Committee of Anh Son district inspected and revoked the Land Use Right Certificate that was issued to Ms. Nguyen Thi Lu's household in 1998 in violation of regulations is related to the article "Nghe An: A woman has been suing for 21 years about land" posted on baonghean.vn on February 8, 2018. In this article, Nghe An Newspaper reported the case of Ms. Ngo Thi Huong (residing in Hamlet 2, Thach Son Commune, Anh Son District) because of the house and land of her mother, Ms. Le Thi Than, on plot No. 662, map No. 8, who has been suing for 21 years. In addition, from the investigation, verification and information obtained from the records and documents of relevant authorities, Nghe An Newspaper affirmed that the issuance of the Land Use Right Certificate in 1998 by the People's Committee of Anh Son district to Ms. Nguyen Thi Lu's household had shortcomings, errors, and was not in accordance with the provisions of law; Ms. Ngo Thi Huong's recommendations are well-founded and legitimate, and need to be considered and resolved decisively.
