Prime Minister requests urgent remedial measures for shortcomings in BOT and BT projects

The Government Office has just announced the Prime Minister's conclusion at the Government's regular meeting on a number of shortcomings, limitations, mechanisms and policies through the audit results of BOT, BT projects and equitization, joint venture and association work.

The announcement stated that the implementation of infrastructure projects under the form of public-private partnership (PPP), especially BOT and BT investment forms, in recent times has revealed a number of shortcomings and limitations that need to be focused on to overcome in order to ensure development goals, socio-economic efficiency and improve the effectiveness of state management of this form of investment.

The Government admits that projects invested in the form of BOT and BT in recent times have revealed a number of shortcomings and limitations.

In order to improve policies and laws, ensure the effective investment and exploitation of traffic works in the form of BOT, BT and equitization, joint ventures and associations, the Prime Minister assigned the Ministry of Planning and Investment to preside over and coordinate with relevant agencies to urgently develop a Government Resolution to implement Resolution No. 437 dated October 21, 2017 of the National Assembly Standing Committee on a number of tasks and solutions to continue improving and promoting the implementation of policies and laws on investment and exploitation of traffic works in the form of BOT contracts.

The Prime Minister assigned the Ministry of Finance to preside over and coordinate with relevant agencies to study and absorb relevant recommendations of the State Audit to continue to complete the content of amendments and supplements to the Government's Decree No. 91/2015/ND-CP dated 15/01/2015 on state capital investment in enterprises and management and use of capital and assets at enterprises; Decree No. 59/2011/ND-CP of the Government on converting 100% state-owned enterprises into joint stock companies and Decision No. 41/2015 of the Prime Minister on regulations on selling shares in lots.

The Ministry of Finance regularly reviews and draws lessons from equitization work; proposes measures to improve the effectiveness of equitization work in the process of restructuring the economy.

The Prime Minister also requested the Ministry of Transport to urgently study and absorb the recommendations of the State Audit to implement effective measures to improve the effectiveness and efficiency of state management in the field of transport infrastructure development, especially the management of the implementation process of projects under the form of BOT and BT contracts.

Continue to comprehensively review and complete strategies and plans for transport infrastructure development, in conjunction with the industry restructuring project, towards harmonious development of transport modes; preside over the development and proposal of priority investment projects in the form of PPP in all fields of roads, railways, seaports, aviation, and inland waterways; orient the establishment of toll stations, thoroughly overcoming the limitations and shortcomings that occurred in the past period.

The Ministry of Transport shall preside over and coordinate with relevant agencies to develop and promulgate contract settlement procedures for investors; carry out settlement of projects in accordance with legal provisions; continue to review reasonable toll collection times for projects, ensuring harmony of interests of the State, investors and people...

Notably, the Prime Minister assigned Deputy Prime Minister Vuong Dinh Hue and Deputy Prime Minister Trinh Dinh Dung to chair an online conference between the Government and localities to review the implementation of investment models under the PPP form, including BOT and BT contracts in the past time, comprehensively assess the advantages and limitations, shortcomings, and propose effective solutions in the coming period.
