Implementing detailed zoning plan of Nghi Lien commune (Vinh city): Listening to people's wishes

The petition of the people of 3 hamlets 9, 10, 17 of Nghi Lien commune sent to Nghe An Newspaper has the content: the people of 3 hamlets have just received the detailed map of Nghi Lien commune subdivision and were surprised to see that on the map, the place names of 3 hamlets have been erased and replaced by Vinh Airport. They are very worried, anxious and upset because in 2006 a similar incident happened. That is, when planning to expand Vinh Airport, the Ministry of Transport said that the land of 3 hamlets is military land managed and arbitrarily included in the planning.
The people of the 3 hamlets wrote: “From 2006 to 2010, the people of the 3 hamlets continuously submitted petitions and complaints to the authorities at all levels. On March 16, 2010, the Provincial People's Committee, through an on-site inspection, confirmed the legal rights of the people. However, after 7 years, when implementing the detailed planning of the commune subdivision, the names of the 3 hamlets were deleted. We consider this a violation of the law; an infringement of the legal rights of citizens...”.

Mr. Le Ngoc Nam - representative of the people of the 3 hamlets said that in 2015, the Ministry of Transport approved the adjustment of the planning of Vinh Airport in Decision No. 347/QD-BGTVT; in which, it still affirmed that the land of the 3 hamlets was military land and included it in the planning. Therefore, when implementing the zoning plan of Nghi Lien commune, people based on the planning of the Ministry of Transport, deleted the names of the 3 hamlets.
Mr. Nam was indignant: “Our ancestors have lived on this land for generations. On this land, in addition to houses, gardens, and fields of hundreds of households with over 2,000 people, there are also historical and cultural relics recognized by the State. These are clear evidences. Why did they implement the planning without grasping the actual situation, why didn’t they announce the policy but insisted that this land was military-managed land, and then arbitrarily put the planning on it...”.
Checking the zoning plan of Nghi Lien commune kept by the people of the 3 hamlets, this plan has not been approved by the competent authority, but it is true that there are no place names of the 3 hamlets, but instead, it shows the land of Vinh Airport Cluster.
Grasping the reality of the 3 hamlets, it is exactly as Mr. Nam informed. In addition to the infrastructure system such as electricity, roads, cultural houses, residential houses... with high stability, in this locality there is also a church, temple of the Le family that has existed for more than 300 years, recognized by the State as a provincial historical and cultural relic.
At the same time, people in the three hamlets also archive quite fully relevant documents of competent authorities, from the commune to the province, resolving petitions from 2010 and earlier on land and planning issues.
Official dispatch No. 1316/UBND-CN dated March 16, 2010 of the Provincial People's Committee affirmed the land use rights of the people: "The land of households in hamlets 9, 10, 17, Nghi Lien commune (Vinh city) is being managed and used, stabilized and has been granted land use right certificates by competent authorities, which is confirmed to be under the legal use rights of these households (not military land under management); The authority to grant, allocate and reclaim land belongs to the Provincial People's Committee and the District People's Committee (not to the ministries and central branches), therefore, households using the land are entitled to fully enjoy their legal rights and interests according to the provisions of the Land Law and other relevant laws...".
Listen to the people's wishes
Since 2016, implementing the direction of the Provincial People's Committee in Official Dispatch 1255/UBND-XD, Vinh City People's Committee has established a 1/2000 scale zoning plan for wards and communes in the area. For Nghi Lien commune, the zoning plan is implemented by Hung Quoc Joint Stock Company.
The planning is carried out by this company in accordance with the legal procedures and regulations, which are to grasp information and data at the commune and city levels and approved and effective plans (including the 2015 Vinh Airport expansion plan of the Ministry of Transport).

According to Mr. Nguyen Cong Ha - Chairman of Nghi Lien Commune People's Committee, after the planning project was established, the consulting unit collected opinions at the city level, with the participation of local representatives; then brought it back to the grassroots to collect people's opinions.
Nghi Lien Commune has 19 hamlets, of which 3 hamlets 9, 10, 17 disagree because the place name is lost on the map, and because the entire land area is included in the Vinh Airport planning. The commune government is also very concerned, because the plan to expand Vinh Airport of the Ministry of Transport was established in 2015 but the commune has no information. Moreover, with this planning, taking away the entire area of 3 hamlets, is it necessary?
Mr. Nguyen Cong Ha said: “Recently, people from 3 hamlets have organized into large groups to go to the city to make a petition. Therefore, during the working session to evaluate the work of planning zoning for wards and communes in the area, the Standing Committee of Vinh City Party Committee clarified the content of the petitions of people from 3 hamlets in Nghi Lien commune. After that, the City People's Committee was directed to report to the Standing Committee of the Provincial Party Committee...”.
According to the representative of the Vinh City Urban Management Department, the failure to include the names of the three hamlets 9, 10, and 17 in the planning drawings was the fault of the consulting unit. However, the planning project was in the process of collecting public opinions, so it was later revised and the names of the three hamlets were returned to the drawings.
At the meeting of the Standing Committee of the City Party Committee, the consulting unit also admitted its mistake. Regarding the planning to expand Vinh Airport, it is necessary to carry out for the socio-economic development of the city and the province. And the policy to implement it, originated from Decision No. 52/QD-TTg dated January 14, 2015 on approving the adjustment of the general planning of Vinh city by the Prime Minister, not just the decision of the Ministry of Transport.
Regarding the people's recommendations, the representative of this department also found them to be legitimate, because if the planning is not realistic, the people in the planning area will be at a disadvantage in terms of their legitimate legal rights in land use, construction, etc.
Raising the issue of needing to correct land information of 3 hamlets 9, 10, 17 which the Ministry of Transport stated in Decision No. 347/QD-BGTVT as military land, also according to the representative of Vinh Urban Management Department: "This issue is beyond the authority of Vinh city. Therefore, the City People's Committee will send a written request to the Provincial People's Committee to consult with the Ministry of Transport...".
According to the Standing Deputy Secretary of the Vinh City Party Committee, Mr. Nguyen Van Lu, recently, the Standing Committee of the City Party Committee held a meeting and clearly instructed units and organizations that when designing planning projects, they need to put themselves in the position of the people to carry out their tasks; they need to closely follow the content of Official Dispatch No. 1316/UBND-CN dated March 16, 2010 of the Provincial People's Committee, to ensure land use rights and other legitimate rights for the people according to the provisions of law.
Regarding the planning of Vinh Airport expansion, it is necessary for the socio-economic development of the city and the province. But how to expand, what items to use, when to implement the planning... need to be specific, and importantly, it is necessary to provide transparent information to the people, while ensuring feasibility. In the near future, Vinh City will invite relevant agencies and leaders of Vinh Airport to clarify these contents. In short, the zoning plan of Nghi Lien commune cannot be implemented hastily...
