Issuing land use right certificates
(Baonghean) - As of the end of 2014, Vinh City had 46 apartment complexes and new urban areas in use, with 2,984 households residing there. However, the Vinh City People's Committee had only issued 879 certificates, reaching only 29.45% of the households.
In order to promptly issue certificates to those receiving land use rights and house ownership rights from investment and construction organizations for sale in Vinh City, and to facilitate homebuyers with land use right certificates to exercise their rights and obligations in real estate transactions, the Chairman of the Provincial People's Committee issued Conclusion Notice No. 83/TB-UBND.DC requesting departments, agencies, and businesses to effectively implement the following contents:
1. For the Department of Natural Resources and Environment:
- Direct and urge investors to promptly submit applications for land allocation and appraisal for approval by the Provincial People's Committee as prescribed; If businesses deliberately fail to comply, announce this through mass media so that the public is aware;
- Coordinate effectively with the Provincial Tax Department in the process of transferring documents to urge businesses to pay land use fees into the State budget;
- Take the lead in coordinating with relevant departments and advising the Provincial People's Committee to organize a working session with real estate investors in the province to address existing problems and obstacles, and resolve difficulties for businesses (to be completed before March 13, 2015).
2. For the People's Committee of Vinh City:
- Continue to implement quickly and effectively the directives of the Provincial People's Committee in Notice No. 286/TB-UBND.DC dated June 12, 2013;
- Strive to basically complete the issuance of certificates to those who receive the transfer of land use rights and ownership of houses from investment and construction organizations for sale in the area (2,105 households) in the first six months of 2015, so that the issuance of land use right certificates to all households can be completed in 2015;
- Actively inspect and urge real estate investors in the area to complete the necessary documents to process the issuance of certificates to households and individuals receiving land transfers. In cases where investors intentionally fail to comply, penalties will be imposed in accordance with the provisions of Government Decree No. 102/204/ND-CP dated November 10, 2014;
- Publicize through mass media outlets the names of investors who are deliberately delaying or failing to comply, so that the public is aware;
- Actively and proactively coordinate with investors to expedite the completion of land compensation and clearance (for areas where work has not yet been completed), creating favorable conditions for investors to implement their projects.
3. For the Nghe An Tax Department:
- Notify and urge investors to complete the payment of funds into the state budget as required;
- There are penalties in place to punish investors who are late in paying taxes into the state budget.
4. For the Department of Construction:
- Guiding, urging, inspecting, and supervising the investor in implementing the project, and organizing the acceptance of the completed construction work;
- Instruct the Vinh City People's Committee or advise the Provincial People's Committee on handling cases of construction not conforming to approved designs (such as unauthorized connection of townhouses or apartment buildings; construction with fewer floors than approved, etc.).
5. For investors:
- Complete the necessary paperwork and submit it to the Department of Natural Resources and Environment to obtain land allocation or land lease for project implementation on schedule;
- Complete the payment of land use fees, charges, and other fees into the state budget as required;
- Hand over completed public infrastructure projects to local authorities for management in accordance with regulations;
- Promptly complete the necessary paperwork and submit it to the Vinh City People's Committee to process the issuance of land use right certificates to the people in accordance with regulations;
- Inform the transferees to complete the necessary paperwork to obtain the certificate;
- Propose recommendations to address difficulties and obstacles in implementation. Request that the Provincial People's Committee and administrative agencies be informed of instances where officials and civil servants intentionally create difficulties or harass others during the performance of their duties, so that appropriate action can be taken.
