Trainee absconds in Japan, company asks parents in hometown to pay fine instead

(Baonghean.vn) - A trainee from Nghe An went to practice at a factory in Japan but before the end of his contract, he escaped and illegally resided abroad. According to the guarantee contract before leaving, the company required the worker's parents in his hometown to pay a fine on behalf of their child.

The Department of Employment, Department of Labor, Invalids and Social Affairs said that the above-mentioned runaway worker is trainee Vo Thi Thanh Mai (born in 1986), permanent resident of My Thuong hamlet, Hung Loc commune, Vinh city. On August 19, 2016, Vo Thi Thanh Mai was sent by Hanoi Technology Training and Development Joint Stock Company in coordination with Kyusyu Factory Kyodo Kumiai Union (Japan) to intern at Takanami Yoshiaki factory (Japan) for a period of 3 years, in the field of agricultural internship.

Before leaving, to ensure that the intern did not violate the contract, Mr. Vo Van Chuong and Ms. Hoang Thi Dung - the intern's parents - used the land use rights of 150m2 to guarantee all of the intern's obligations to the company until returning to Vietnam to terminate the contract. However, on August 12, 2017, intern Vo Thi Thanh Mai escaped from the factory and illegally resided outside.

Hanoi Technology Training and Development Joint Stock Company sent a dispatch to the People's Committee of Nghe An province, in which it provided information about the absconding behavior of intern Vo Thi Thanh Mai and stated: "The behavior of intern Vo Thi Thanh Mai violated Clause 2, Article 35 of Decree No. 95/2013/ND-CP regulating administrative sanctions in the fields of labor, social insurance and sending Vietnamese workers to work abroad under contracts."

The enterprise requested the People's Committee of Nghe An province, based on the authority prescribed in Decree 95, to issue a Decision on administrative sanctions against intern Vo Thi Thanh Mai. At the same time, based on the guarantee contract, the intern's parents were required to fulfill their obligation to pay the fine in lieu of their child's violation.

Upon receiving the dispatch, the People's Committee of Nghe An province assigned the Department of Labor, Invalids and Social Affairs to review and resolve the petition of Hanoi Technology Training and Development Joint Stock Company.

Immediately afterwards, the Department sent an official dispatch to this company, requesting the company to provide the labor contract that trainee Vo Thi Thanh Mai signed with the Japanese employer, the guarantee record of the trainee's family and the notice of Takanami Yoshiaki Factory about the trainee Vo Thi Thanh Mai's escape and illegal residence in Japan to have a basis for settlement in accordance with the provisions of law.

It is known that up to now, the company has not sent the documents and papers as requested by the Department of Labor, Invalids and Social Affairs, the processing is waiting for the completion of legal procedures. The Department of Employment, Department of Labor, Invalids and Social Affairs said that on average, each year, the Department receives about 10 similar documents about the absconding behavior of Nghe An workers in Japan.

The act of fleeing and illegally residing by workers has violated Vietnamese and Japanese laws, tarnishing the image of Vietnamese trainees in general and Nghe An trainees in particular in the eyes of trade unions and enterprises in neighboring countries, seriously affecting the continued acceptance of Vietnamese trainees to work in Japan./.
