Clause 2, Article 35 of the Road Traffic Law stipulates that acts such as: Holding markets, buying and selling goods on the road; illegally gathering crowds on the road; drying rice, paddy, straw, agricultural products or leaving other objects on the road; ... will be prohibited and strictly punished. Depending on the level of danger and consequences caused, violators may be subject to administrative sanctions or criminal prosecution. According to Clause 1, Article 12 of Decree 46/2014/ND-CP dated May 26, 2016, individuals and organizations that "dry rice, paddy, straw, stubble, agricultural, forestry and seafood products on the road" may be fined from 100,000 to 400,000 VND. Regarding criminal handling: In case of violations that cause damage to life or serious damage to the health or property of others, the violator may be prosecuted for "Crime of obstructing road traffic" according to the provisions of Article 203 of the 1999 Penal Code (amended and supplemented in 2009) with penalties of a fine from 5 million to 30 million VND, non-custodial reform for up to 2 years or imprisonment from 3 months to 3 years... |
