Returning additional investigation files for many cases of firecracker trafficking

At the working session, reporting to the monitoring delegation, Mr. Ho Dinh Trung - Chief Justice of the Provincial People's Court said that from January 2015 to June 2017, for cases of violating economic management order, the People's Courts at 2 levels of Nghe An accepted 184 cases, 276 defendants, resolved 183 cases, 275 defendants. Of which, the majority of cases were accepted by the district court with 155 cases, 233 defendants.

The cases of economic management violations that the two-level people's courts have handled account for a large number of crimes of manufacturing, storing, transporting, and trading in prohibited goods, mostly firecrackers, with 119 cases and 164 defendants. The rest are mainly crimes related to violations of regulations on forest exploitation and protection (13 cases, 38 defendants); transporting and circulating counterfeit money, checks, and bonds (8 cases, 8 defendants); tax evasion (7 cases, 7 defendants); illegal trading of invoices and documents (3 cases, 9 defendants)...

Mr. Ho Dinh Trung also expressed concern about the fact that very few cases of economic management violations were discovered and tried, mainly cases related to the trading and transportation of firecrackers. And due to the change in the situation, the Supreme People's Court issued a specific directive, so in more than 2 years, from January 2015 to June 2017, nearly 70 cases related to the trading of firecrackers were suspended and the case files were returned for further investigation.

The representative of the Provincial People's Court requested the monitoring delegation to recommend to the National Assembly and the Central Judicial Agencies to promptly issue documents guiding the implementation of crimes in the field of economic management order according to the 2015 Penal Code; change the salary regime for judicial positions and increase the trial allowance for People's Jurors. In addition, due to the requirement of streamlining the payroll, the Provincial People's Court is facing difficulties in personnel for professional work.

Delegates attending the meeting also discussed and evaluated the situation and quality of the People's Jury's work; concerns in the trial of ethnic minority subjects violating regulations on forest exploitation and protection when clearing land for farming; reasons why some cases were returned for further investigation; coordination between the four sectors in handling cases...

The members of the monitoring delegation highly appreciated the results of the trials of economic management order violations by the Provincial People's Court in the past time. Regarding some contents related to the monitoring content, the delegation requested the Provincial People's Court to provide more data on cases whose files were returned for further investigation; the handling of evidence such as explosives; the role and contribution of lawyers in the trials of economic management order violations; requested the Provincial People's Court to make specific recommendations on measures to handle, prevent and stop violations of regulations on forest exploitation and protection... so that the delegation can synthesize and report to relevant levels and sectors.
