The Ministry of Labour, Invalids and Social Affairs has recently issued a document providing guidance on calculating annual leave pay.

Accordingly, if an employer requires employees to work overtime on an annual leave day as stipulated by the employer, the employee shall be paid overtime at least 300% of their actual salary, excluding the paid leave for employees paid on a daily basis;

In cases where an employee resigns, loses their job, or for other reasons has not taken or has not used all of their annual leave days, they are entitled to be paid 100% of their annual leave pay as stipulated in their employment contract.

In addition, the document from the Ministry of Labour, Invalids and Social Affairs also provides guidance on annual leave during the probationary period: after the probationary period, if a labor contract is signed, the leave is counted as annual leave; if no labor contract is signed, the corresponding annual leave pay is provided.
